Stat. tit. 17, § 17-190.7","heading":"Furnishing of retail electric service to facilities","body":"currently being served - Extension of distribution service by\n\nmunicipalities - Prohibitions.\n\nA. Electric distribution providers governed by the Retail\n\nElectric Supplier Certified Territory Act, Section 158.21 et seq. of\n\nthis title or municipal corporations or beneficial trusts thereof\n\nowning or operating a retail electric distribution system or the\n\nGrand River Dam Authority shall not furnish retail electric service\n\nto an electric consuming facility which is currently being served,\n\nor which was being served and the permanent electric facilities are\n\nin place to render such service, by a municipal corporation or\n\nbeneficial trust thereof, a rural electric cooperative or an\n\ninvestor-owned electric utility or the Grand River Dam Authority\n\nuntil enactment of electric restructuring enabling legislation and\n\nthe implementation of consumer choice of retail electric energy\n\nsuppliers unless the entities involved have agreed by mutual\n\nconsent, in writing, to such transaction. For the purpose of this\n\nsection, \"electric distribution providers\" shall mean the same as\n\n\"retail electric service distributors\" as defined by Section 190.3\n\nof this title.\n\nB. Any municipal corporation or beneficial trust thereof\n\noffering retail electric distribution service from a municipally or\n\ntrust-owned electric distribution system that decides not to\n\nparticipate in the provisions of this act as outlined in Section\n\n190.3 of this title shall be prohibited from extending a retail\n\nelectric distribution primary feeder system beyond its corporate\n\nlimits with the exception that it may continue to offer retail\n\nelectric distribution service through the addition of secondary\n\nservice drops from the primary feeder system it owned outside the\n\ncorporate limits of such municipality on April 25, 1997. Provided,\n\nhowever, nothing contained in this section shall be construed to\n\nprohibit system maintenance, repairs or upgrades to such primary\n\ndistribution feeder system outside the corporate limits except that\n\nsecondary service drops shall not be upgraded to primary\n\ndistribution lines.","path":["OK Code","Title 17"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os17.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"d728a00fd078dc3846478541e561b93784a1978257b6392f2658b726bf02f631","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-17-17-190.5","next":"us-ok/okla.-stat.-tit.-17-17-190.8"},"notice":"GroundRules: Original legal text.
