Stat. tit. 17, § 17-259","heading":"Monitoring of application of adjustment clauses","body":"Whenever the Commission approves a purchased power adjustment\n\nclause pursuant to Section 258 of this title, the clause shall apply\n\nto all similar distribution cooperatives affected by such increased\n\ncosts. In addition, the Commission shall continually monitor and\n\noversee the application of the adjustment clauses. The Commission\n\nshall hold a public hearing thereon whenever it deems it necessary,\n\nbut no less frequently than once every twelve (12) months. The\n\nCommission shall undertake such other investigation thereof as is\n\nnecessary to determine whether:\n\n1. Charges or credits made under the adjustment clauses are\n\nbased upon the actual prices paid for purchased power, are properly\n\ncomputed in accordance with the applicable adjustment clause, and\n\nthat portion representing fuel adjustment charges made by an\n\nelectric generation cooperative are fair, equitable and properly\n\ncomputed; or\n\n2. Whether the purchased power adjustment clause should be\n\namended, suspended or discontinued.\n\nIf the Commission finds that the charges or credits are not based\n\nupon the actual prices paid for purchased power, or are not properly\n\ncomputed in accordance with the applicable adjustment clause, it\n\nshall recompute the charges or credits. Appropriate adjustments\n\nshall then be ordered by the Commission in the amount used in\n\ncalculating the power adjustment charge for one (1) or more\n\nsucceeding months under the purchased power adjustment clause by the\n\nelectric distribution cooperative making the error.
