An incumbent electric transmission owner has the right to\n\nconstruct, own and maintain a local electric transmission facility\n\nthat has been approved for construction in a Southwest Power Pool\n\ntransmission plan and will interconnect to facilities owned by that\n\nincumbent electric transmission owner. An incumbent electric\n\ntransmission owner has the right to construct, own and maintain:\n\n1. A new local electric transmission facility that connects to\n\nelectric transmission facilities owned by the incumbent; and\n\n2. Upgrades to the existing local electric transmission\n\nfacilities of the incumbent.\n\nB. The right to construct, own and maintain a local electric\n\ntransmission facility that will interconnect to facilities owned by\n\ntwo or more incumbent electric transmission owners belongs\n\nindividually and equally to each incumbent electric transmission\n\nowner, unless otherwise agreed upon in writing by the incumbent\n\nelectric transmission owners.\n\nC. Nothing in this section is intended to affect an incumbent\n\nelectric transmission owner’s use and control of its existing\n\nproperty rights including the incumbent electric transmission\n\nowner’s ability to assign its rights to construct, own and maintain\n\na local electric transmission facility described in subsection A of\n\nthis section.
