If the Southwest Power Pool has approved a local electric\n\ntransmission facility in a Southwest Power Pool transmission plan\n\nand has formally directed the incumbent electric transmission owner\n\nor owners, if there is more than one owner, to construct, own and\n\nmaintain the local electric transmission facility, the incumbent\n\nelectric transmission owner or owners shall give notice to the\n\nSouthwest Power Pool, in writing, within ninety (90) days of receipt\n\nof the direction to construct by the Southwest Power Pool, regarding\n\nits intent to construct, own and maintain the local electric\n\ntransmission facility. If notice is not provided, the incumbent\n\nelectric transmission owner shall surrender its right to construct,\n\nown and maintain the local electric transmission facility.\n\nB. If an incumbent electric transmission owner or owners give\n\nnotice of intent not to construct the local electric transmission\n\nfacility or fail to provide notice as required in subsection A of\n\nthis section, then the Southwest Power Pool may determine whether\n\nthe incumbent electric transmission owner or owners or other entity\n\nwill construct, own and maintain the local electric transmission\n\nfacility.\n\nC. Nothing in this section is intended to limit the ability of\n\nany person to notify the Southwest Power Pool that it believes an\n\nincumbent electric transmission owner with the right to construct,\n\nown and maintain a local electric transmission facility originally\n\napproved by the Southwest Power Pool has failed to exercise its\n\nright to construct, own and maintain the local electric transmission\n\nfacility within a reasonable period of time and request that the\n\nSouthwest Power Pool rescind the right to construct, own and\n\nmaintain the local electric transmission facility and assign the\n\nrights to another incumbent electric transmission owner.","path":["OK Code","Title 17"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os17.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"e75300563768ae7705ff18fdb4fed6c737bfe7d66fb2c7a4d0e3c84113ce291d","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-17-17-292","next":"us-ok/okla.-stat.-tit.-17-17-294"},"notice":"GroundRules: Original legal text.
