Stat. tit. 17, § 17-301","heading":"Short title – Oklahoma Petroleum Storage Tank","body":"Consolidation Act - Oklahoma Petroleum Storage Tank Division –\n\nResponsibilities of Division.\n\nA. Sections 301 through 348.9 of this title shall be known and\n\nmay be cited as the \"Oklahoma Petroleum Storage Tank Consolidation\n\nAct\".\n\nB. For the purposes of implementing the Oklahoma Petroleum\n\nStorage Tank Consolidation Act, there is hereby recognized the\n\nOklahoma Petroleum Storage Tank Program administered by the\n\nPetroleum Storage Tank Division of the Oklahoma Corporation\n\nCommission.\n\nC. The Petroleum Storage Tank Division shall maintain, operate\n\nand administer the Oklahoma Petroleum Storage Tank Program and shall\n\ninclude, but not be limited to, regulatory compliance activities,\n\nenforcement of rules promulgated to implement regulatory programs,\n\ntechnical review, development and approval of corrective action\n\nplans and determinations that remediation of contaminated sites is\n\ncomplete.\n\nD. The Petroleum Storage Tank Division shall maintain, operate\n\nand administer the Petroleum Storage Tank Indemnity Fund (Indemnity\n\nFund) and shall include, but not be limited to, processing,\n\nreviewing and paying claims for corrective action costs resulting\n\nfrom a release of regulated substances and mitigate environmental,\n\nhealth and safety threats to the public. The Administrator of the\n\nIndemnity Fund shall maintain, operate and administer the Indemnity\n\nFund, and process, review and pay claims to those individuals deemed\n\neligible for reimbursement for corrective action at eligible\n\npetroleum release sites.\n\nE. The Petroleum Storage Tank Division shall maintain, operate\n\nand administer an inspection program for facilities that store or\n\ndispense Commission-regulated substances for the purpose of\n\ndetermining whether such products comply with the specifications,\n\nrequirements, rules and orders of the Corporation Commission and the\n\nlaws of the state.\n\nF.
