All aboveground storage tanks utilized by marinas which are\n\nrequired to be upgraded before July 15, 2007, pursuant to the\n\nprovisions of permanent Rule OAC 165:26-8-2 and required to meet\n\ncertain design requirements pursuant to the provisions of permanent\n\nRule OAC 165:26-2-1.3, shall be exempt from such requirements until\n\nthe Corporation Commission promulgates new rules if the marina is\n\nusing an underground storage tank with secondary containment, the\n\nrisk to the environment and human health, safety, and welfare is\n\nminimal, and compliance with the upgrade requirements would result\n\nin closure of the storage tank system or cause economic hardship to\n\nthe owner of the storage tank system. Marina owners or operators in\n\nthis state operating a motor fuel dispensing facility shall not be\n\nrequired to have an attendant or supervisor on duty to supervise,\n\nobserve or control the dispensing of fuel.\n\nB. All aboveground storage tanks utilized by retail facilities\n\nwhich are required to meet Underwriters Laboratories (UL) or\n\nAmerican Petroleum Institute (API) standards for aboveground fuel\n\nstorage tanks pursuant to the provisions of permanent Rule OAC\n\n165:26-10-2 and are required to meet certain design requirements\n\npursuant to the provisions of permanent Rule OAC 165:26-2-1.3 shall\n\nbe exempt from such requirements until the Corporation Commission\n\npromulgates new rules, if the retail facility is using an\n\nunderground storage tank with secondary containment, the risk to the\n\nenvironment and human health, safety and welfare is minimal, and\n\ncompliance with the tank requirements would result in closure of the\n\nstorage tank system or cause economic hardship to the owner of the\n\nstorage tank system.\n\nC. All aboveground storage tanks utilized by fleet and\n\ncommercial facilities which are required to meet Underwriters\n\nLaboratories (UL) or American Petroleum Institute (API) standards\n\nfor aboveground fuel storage tanks pursuant to the provisions of\n\npermanent Rule OAC 165:26-12-2 and are required to meet certain\n\ndesign requirements pursuant to the provisions of permanent Rule OAC\n\n165:26-2-1.3 shall be exempt from such requirements until the\n\nCorporation Commission promulgates new rules, if the fleet or\n\ncommercial facility is using an underground storage tank with\n\nsecondary containment, the risk to the environment and human health,\n\nsafety and welfare is minimal, and compliance with the tank\n\nrequirements would result in closure of the storage tank system or\n\ncause economic hardship to the owner of the storage tank system.\n\nD. Any rules promulgated by the Corporation Commission\n\ngoverning the design and labeling of aboveground storage tanks shall\n\nbe amended to allow storage tanks designed and built for underground\n\nuse to be used as aboveground storage tanks if used with secondary\n\ncontainment and if the storage tanks were installed for that use\n\nprior to July 1, 2007.
