Stat. tit. 17, § 17-305","heading":"Corporation Commission and Department of Environmental","body":"Quality designated as state agencies to administer certain federal\n\nprograms.\n\nWithin their respective jurisdictional areas, the Corporation\n\nCommission and the Department of Environmental Quality are hereby\n\ndesignated as the state agencies to administer subtitle I of Title\n\nVI of the Solid Waste Disposal Act and Section 205 of the Superfund\n\nAmendments and Reauthorization Act of 1986, 42 U.S.C.A., Section\n\n6991 et seq. The Corporation Commission shall have jurisdiction\n\nover underground and aboveground storage tanks that contain\n\nantifreeze, motor oil, motor fuel, gasoline, kerosene, diesel, or\n\naviation fuel and that are not located at refineries or at upstream\n\nor intermediate shipment points of pipeline operations, including,\n\nbut not limited to, tanks from which these materials are dispensed\n\ninto vehicles, or tanks used in wholesale or bulk distribution\n\nactivities, as well as leaks from pumps, hoses, dispensers, and\n\nother ancillary equipment associated with the tanks, whether above\n\nthe ground or below; provided that any point source discharge of a\n\npollutant to waters of the United States during site remediation or\n\nthe off-site disposal of contaminated soil, media, or debris shall\n\nbe regulated by the Department of Environmental Quality.
