Stat. tit. 17, § 17-307","heading":"Corporation Commission - Rules governing storage tank","body":"systems.\n\nA. The Corporation Commission shall promulgate rules governing\n\nstorage tank systems. The Commission's rules shall, at a minimum,\n\ninclude the following provisions:\n\n1. Requirements that release detection methods or equipment or\n\nboth such methods and equipment, adequate to identify releases from\n\nstorage tank systems, be maintained;\n\n2. Procedures to follow when release detection methods or\n\nequipment or both such methods and records indicate an abnormal loss\n\nor gain which is not explainable by spillage, temperature variations\n\nor other known causes;\n\n3. Requirements that appropriate corrective action be taken in\n\nresponse to a release from a storage tank system as may be necessary\n\nto protect human health, safety and welfare and the environment;\n\n4. Requirements to maintain records documenting actions taken\n\nin accordance with paragraphs 1 through 3 of this subsection;\n\n5. An enforcement program;\n\n6. Requirements that notice be given to landowners whose\n\nproperty has been or may be affected by a release and providing such\n\nlandowner the opportunity to have input into any activities\n\nimpacting such landowners property;\n\n7. Procedures to allow an adjacent property owner whose\n\nproperty has been contaminated by a release to engage in corrective\n\naction on his or her own property under the same requirements as the\n\ntank owner or operator responsible for performing corrective action;\n\nand\n\n8. Minimum schedules and standards for the design,\n\nconstruction, installation, operation, maintenance, repair,\n\nmonitoring, testing, inspection, release detection, performance,\n\nabandonment and closure, of storage tank systems, as may be\n\nnecessary to protect human health, safety and welfare and the\n\nenvironment.\n\nB. In promulgating rules establishing standards pursuant to\n\nparagraph 8 of subsection A of this section, the Commission may\n\ndistinguish in such standards between requirements appropriate for\n\nstorage tank systems. In making such distinctions, the Commission\n\nmay consider the following factors:\n\n1. Location of the storage tanks;\n\n2. Soil and climate conditions;\n\n3. Uses of the storage tanks;\n\n4. History of maintenance;\n\n5. Age of the storage tanks;\n\n6. National industry codes;\n\n7. Hydrogeology;\n\n8. Water table;\n\n9. Size of the storage tanks;\n\n10. Quantity of regulated substances periodically deposited in\n\nor dispensed from the storage tank;\n\n11. The compatibility of the regulated substance and the\n\nmaterials of which the storage tank is fabricated; and\n\n12. Any other factors as deemed necessary by the Commission\n\npursuant to the provisions of the Oklahoma Petroleum Storage Tank\n\nConsolidation Act.\n\nC. The Commission may promulgate rules establishing different\n\nrequirements for different areas or regions of the state if the\n\nCommission finds that more stringent rules are necessary:\n\n1. To protect specific waters of the state including but not\n\nlimited to those waters of the state designated for additional\n\nprotection in Oklahoma's water quality standards; or\n\n2. Because conditions peculiar to that area or region require\n\ndifferent standards to protect public health, safety, welfare or the\n\nenvironment.\n\nD. In promulgating rules pursuant to the provisions of the\n\nOklahoma Petroleum Storage Tank Consolidation Act, the Commission\n\nshall consider all relevant federal standards and regulations on\n\nstorage tank systems. If the Commission promulgates any rule that\n\nis more stringent than a federal standard or regulation on the same\n\nsubject, the Commission shall clearly express the deviation from the\n\nfederal standard or regulation and the reasons for the deviation at\n\na public hearing or at time of adoption of the rule.","path":["OK Code","Title 17"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os17.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"92b178a2f24035f76c6f150765441702b3db366eba4e65cdf39f06fa56d32ca3","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-17-17-306.1","next":"us-ok/okla.-stat.-tit.-17-17-308"},"notice":"GroundRules: Original legal text.
