The Commission shall provide notice and an opportunity\n\nfor hearing to:\n\na. the surface owner of real property where any\n\ncorrective action is to be taken if such person is not\n\nthe owner or operator of the storage tank system, and\n\nb. the owner of real property adjacent to the location of\n\nthe corrective action if such real property owner will\n\nbe adversely affected by the corrective action.\n\n2. The notice shall advise such real property owner or owners\n\nthat the corrective action is to be taken and that the owner's\n\ncooperation will be required for that action to be taken. The\n\nCommission shall give the owner or owners of such real property, as\n\nthe case might be, an opportunity for hearing and to present\n\nevidence on the matter.\n\nB. 1. The Commission is vested with the adjudicative authority\n\nto enter orders allowing a petroleum storage tank system owner,\n\noperator or otherwise responsible person access to property not\n\nowned by the tank owner, operator or otherwise responsible person\n\nwhen necessary to investigate, remediate or perform corrective\n\naction as the result of a release. Actions shall be brought by the\n\ntank owner, operator or otherwise responsible person seeking access\n\nto the property not owned by the tank owner, operator, otherwise\n\nresponsible person or by the Director of the Petroleum Storage Tank\n\nDivision.\n\n2. An order granting access shall only be entered upon a\n\ndetermination that access cannot be obtained by any other means and\n\nthat the petroleum storage tank system owner, operator or otherwise\n\nresponsible person seeking access has made a good-faith effort to\n\nobtain access.\n\n3. The Commission shall determine the reasonable compensation,\n\nif any, to be paid to the owner of the property which is to be\n\naccessed for the use of the property to investigate, remediate or\n\nperform corrective action as the result of a release.\n\n4.
