Stat. tit. 17, § 17-318","heading":"Licensing of storage tank professionals - Contractors","body":"required to meet training and other requirements of federal and\n\nstate laws and regulations.\n\nA. 1. The Corporation Commission is authorized to implement a\n\nprogram for the licensing of petroleum storage tank professionals.\n\nPersons licensed by the Commission as environmental consultants must\n\nhave the training, education and experience as may be required by\n\nthe Commission. Persons seeking to become licensed may be required\n\nto demonstrate knowledge, experience and expertise of soil and water\n\nprotection and remediation techniques and the regulation of\n\npetroleum storage tanks.\n\n2. The Corporation Commission shall require that all\n\ncontractors and their employees participating in the removal of\n\nstorage tanks and the corrective action or remediation of\n\ncontaminated tank sites meet all training and other requirements of\n\nfederal law and regulations, and state statutes.\n\nB. 1. The Commission may deny, suspend, revoke, or reinstate\n\nthe license of a petroleum storage tank professional.\n\n2. The Commission shall promulgate rules establishing the basis\n\nfor denial, suspension, revocation, or reinstatement of a petroleum\n\nstorage tank professional license, and establishing procedures for\n\ndisciplinary actions.\n\n3. The burden of proof in all proceedings brought pursuant to\n\nthis section shall be clear and convincing evidence.\n\n4. Proceedings relating to the suspension or revocation of a\n\nlicense issued pursuant to this section are subject to the hearing,\n\npenalty and enforcement provisions of the Oklahoma Petroleum Storage\n\nTank Consolidation Act.\n\n5. A person whose license has been revoked in a proceeding\n\nbrought pursuant to this section may apply for a new license after\n\nthe expiration of a term of no less than one (1) year and no more\n\nthan five (5) years from the date of revocation, depending on the\n\ndecision of the Director of the Petroleum Storage Tank Division of\n\nthe Corporation Commission. Upon a subsequent determination of\n\nviolation of:\n\na. the Oklahoma Petroleum Storage Tank Consolidation Act,\n\nb. the Oklahoma Petroleum Storage Tank Indemnity Fund, or\n\nc. promulgated rules,\n\nthe Commission may, after notice and hearing, revoke a petroleum\n\nstorage tank professional license for a term no less than five (5)\n\nyears.","path":["OK Code","Title 17"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os17.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"d756b297970485177eeafe0118413313707582d014786428da758712338b39e3","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-17-17-316","next":"us-ok/okla.-stat.-tit.-17-17-319"},"notice":"GroundRules: Original legal text.
