The Corporation Commission is authorized to implement an\n\nUnderground Storage Tank Operator Training Program as required to\n\ncomply with the provisions of the federal Energy Policy Act of 2005.\n\nB. The Commission shall develop a training program within their\n\nagency it deems appropriate to fulfill the requirements of federal\n\nlaw or the provisions of this section.\n\nC. Operators of underground storage tanks shall complete a\n\ntraining program commensurate with their responsibility for the\n\noperation of underground storage tanks. The training program shall\n\nbe approved by the Commission and encompass training for persons\n\nwith three levels of responsibility for storage tank operation as\n\nfollows:\n\n1. Persons having primary responsibility for on-site operation\n\nand maintenance of underground storage tank systems;\n\n2. Persons having daily on-site responsibility for the\n\noperation and maintenance of underground storage tank systems; and\n\n3. Persons with daily, on-site primary responsibility for\n\naddressing emergencies presented by a spill or release from an\n\nunderground storage tank.\n\nD. Storage tank operators shall be required to complete the\n\ntraining program required by the Commission to obtain certification\n\nfor the operation of underground storage tanks.\n\nE. Operators of underground storage tank systems shall repeat\n\nthe applicable training if the tank for which they have primary\n\ndaily on-site management responsibilities is determined to be out of\n\ncompliance with a requirement or order of the Commission.\n\nF.
