Stat. tit. 17, § 17-322","heading":"Petroleum Storage Tank Division - Jurisdiction - Director","body":"- Powers and duties.\n\nA. 1. Effective July 1, 1998, there is hereby established the\n\nPetroleum Storage Tank Division within the Corporation Commission,\n\nwhich shall have separate budget activities and subactivities from\n\nany other division of the Commission.\n\n2. The Petroleum Storage Tank Division shall be funded by\n\navailable federal funds, grants, fees, and appropriations.\n\nB. 1. The Petroleum Storage Tank Division shall be the sole\n\ndivision of the Commission with jurisdiction over releases and\n\nspills from petroleum storage tanks.\n\n2. The acts and programs specified by this paragraph shall\n\nconstitute a part of the Oklahoma Petroleum Storage Tank\n\nConsolidation Act and shall be subject to the jurisdiction of the\n\nDivision. This jurisdiction shall include, but not be limited to,\n\nthe administration of the following previous acts, programs, funds\n\nand inspections:\n\na. the Oklahoma Petroleum Storage Tank Regulation Act,\n\nb. the Oklahoma Petroleum Storage Tank Reform Act,\n\nc. the Oklahoma Petroleum Storage Tank Release Indemnity\n\nFund Program,\n\nd. the Oklahoma Petroleum Storage Tank Release\n\nEnvironmental Cleanup Indemnity Fund,\n\ne. the Oklahoma Storage Tank Regulation Revolving Fund,\n\nf. the Oklahoma Leaking Underground Storage Tank Trust\n\nFund,\n\ng. the Oklahoma Leaking Underground Storage Tank Trust\n\nRevolving Fund,\n\nh. Compliance and Inspection,\n\ni. Petroleum Storage Tank Registration, Licensing, and\n\nj. Antifreeze.\n\n3. All positions in the Petroleum Storage Tank Division shall\n\nbe unclassified. Those employees who are classified on the\n\neffective date of this act may elect to remain classified pursuant\n\nto Section 840-4.2 of Title 74 of the Oklahoma Statutes.\n\n4. All rules promulgated and orders entered by the Oklahoma\n\nCorporation Commission prior to the effective date of this act\n\nrelated to the programs, funds and services of the Petroleum Storage\n\nTank Division and shall remain in full force and effect until\n\noverturned, amended, modified, revoked or repealed by the\n\nCorporation Commission and shall be enforced by the Petroleum\n\nStorage Tank Division.\n\nC. 1. The Director of the Petroleum Storage Tank Division\n\nshall be appointed by the Director of Administration of the\n\nCorporation Commission. All other employees of the Petroleum\n\nStorage Tank Division shall be hired by the Director of the\n\nPetroleum Storage Tank Division.\n\n2. The Director shall provide for the administration of the\n\nPetroleum Storage Tank Division and shall:\n\na. develop the organizational framework of the Petroleum\n\nStorage Tank Division,\n\nb. define duties and set salaries of employees, to employ\n\na sufficient number of employees to accomplish the\n\nduties and responsibilities of the programs, funds and\n\nservices of the Petroleum Storage Tank Division,\n\nincluding but not limited to such assistants,\n\nchemists, geologists, hydrologists, storage tank\n\nprofessionals, engineers, administrative, clerical and\n\ntechnical personnel, investigators, aides and such\n\nother personnel, either on a full-time, part-time, fee\n\nor contractual basis, as in the judgment and\n\ndiscretion of the Director shall be deemed necessary,\n\nexpedient, convenient or appropriate to the\n\nperformance or carrying out of any of the purposes,\n\nobjectives, responsibilities or statutory provisions\n\nrelating to the Petroleum Storage Tank Division,\n\nc. establish internal policies and procedures for the\n\nproper and efficient administration of the Division,\n\nd. clearly delineate the duties and responsibilities of\n\nthe various programs as prescribed by law within the\n\njurisdiction of the Division,\n\ne. create and implement an internal coordinated\n\nmanagement system among the Storage Tank Regulation\n\nProgram and the Indemnity Fund,\n\nf. the Indemnity Fund Administrator and all other\n\nemployees of the Indemnity Fund shall be hired by the\nof the Division,\n\nd. clearly delineate the duties and responsibilities of\n\nthe various programs as prescribed by law within the\n\njurisdiction of the Division,\n\ne. create and implement an internal coordinated\n\nmanagement system among the Storage Tank Regulation\n\nProgram and the Indemnity Fund,\n\nf. the Indemnity Fund Administrator and all other\n\nemployees of the Indemnity Fund shall be hired by the\n\nDirector of the Petroleum Storage Tank Division of the\n\nCorporation Commission,\n\ng. Indemnity Fund employees shall be in the unclassified\n\nservice and shall be exempt from the agency full-time-\n\nequivalent limit. All employees involved in reviewing\n\nand approving claims and in the approval and issuance\n\nof payments shall be employees of the Indemnity Fund\n\nunder the supervision of the Director or Director's\n\ndesignee,\n\nh. the Director is authorized to employ temporary\n\nworkers, contract labor, or to contract with a private\n\ncompany as may be prudent to properly administer the\n\nIndemnity Fund, and\n\ni. exercise all incidental powers which are necessary and\n\nproper to implement the purposes of the Division\n\npursuant to the Oklahoma Petroleum Storage Tank\n\nConsolidation Act and to implement all programs within\n\nthe Division's jurisdiction.","path":["OK Code","Title 17"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os17.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"de064ca459cabea807be441fd3a8c8b0e47e99c8e96adabb9d0ecf4c5ca5ca50","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-17-17-321","next":"us-ok/okla.-stat.-tit.-17-17-324"},"notice":"GroundRules: Original legal text.
