Payment of any claim from the Indemnity Fund shall be\n\nsubject to the Indemnity Fund acquiring by subrogation the right to\n\nrecover from any person any amounts paid by the Indemnity Fund to or\n\non behalf of any eligible person which may be determined to be\n\nfraudulent, reimbursable by other sources, or excessive. The\n\nAdministrator shall bring an action on behalf of the Indemnity Fund\n\nto recover any such monies in the district court where the property\n\nis located or where the person from whom recovery is sought resides.\n\nThe prevailing party in such cases shall be entitled to recover\n\ninterest, costs of the action and attorney fees. Costs of the\n\naction shall include filing fees, administrative costs, witness fees\n\nand expenses related to the proceeding.\n\nB. The Administrator is authorized to represent and protect the\n\nIndemnity Fund in any state or federal judicial or administrative\n\nproceeding.\n\nC. Any person who is a party to a lawsuit and who may request\n\nany payment or reimbursement payable from the Indemnity Fund as a\n\nresult of such lawsuit shall notify the Administrator upon being\n\nserved with notice of the lawsuit.
