No person shall sell or offer for sale motor fuel from a\n\nmotor fuel dispenser supplied by a storage tank into which motor\n\nfuel that contains a mixture of at least one percent (1%) by volume\n\nof ethanol or methanol has been delivered within the sixty-day\n\nperiod preceding the date of sale or offer of sale unless the person\n\nprominently displays on the dispenser from which the mixture is sold\n\na label that complies with subsection B of this section.\n\nB. 1. A label as required in subsection A of this section\n\nshall:\n\na. be displayed on each face of the motor fuel dispenser\n\non which the price of the motor fuel mixture sold from\n\nthe dispenser is displayed,\n\nb. state “Contains Ethanol” or “Contains Methanol”, as\n\napplicable,\n\nc. appear in contrasting colors with block letters at\n\nleast one-half (1/2) inch high and one-fourth (1/4)\n\ninch wide, and\n\nd. be displayed in a clear, conspicuous and prominent\n\nmanner, visible to customers using either side of the\n\ndispenser.\n\n2. If the motor fuel contains fifteen percent (15%) ethanol, a\n\npump label as required in subsection A of this section shall meet\n\nfederal E15 labeling requirements as ruled by the Environmental\n\nProtection Agency pursuant to 40 CFR Part 1090.1510 as it is written\n\non February 1, 2023.\n\nC. If a motor fuel dispenser is supplied by a storage tank into\n\nwhich motor fuel containing at least ten percent (10%) ethanol by\n\nvolume or at least five percent (5%) methanol by volume is delivered\n\nin the sixty-day period preceding the date of the sale or offer of\n\nsale, the sign as required in subsection A of this section shall\n\nalso state the percentage of ethanol or methanol by volume, to the\n\nnearest whole percent, of the motor fuel having the highest\n\npercentage of ethanol or methanol delivered into that storage tank\n\nduring that period.\n\nD. On request by a motor fuel user, a person selling or\n\noffering for sale motor fuel from a motor fuel dispenser shall\n\nreveal:\n\n1. The percentage of ethanol contained in the motor fuel being\n\nsold;\n\n2. The percentage of methanol contained in the motor fuel being\n\nsold; and\n\n3. If the motor fuel contains methanol, the types and\n\npercentages of associated cosolvents contained in the motor fuel\n\nbeing sold.\n\nE. The provisions of this section shall not prohibit the\n\nposting of any other alcohol or additive information. Other alcohol\n\nor additive information and any relevant posting shall be subject to\n\nregulation by the Corporation Commission.\n\nF.
