Stat. tit. 17, § 17-4","heading":"Suspension bond","body":"If the order violated for which such fine or judgment is imposed\n\nshall have been an order promulgating or fixing rates, to be charged\n\nby public service corporations, persons or firms, it shall be\n\nnecessary in appealing from such fine or judgment for the defendant\n\nto give a suspending bond, executed and filed with and approved by\n\nthe Commission, payable to the state, and sufficient in amount and\n\nsecurity to insure the prompt refunding by the appealing\n\ncorporation, person or firm, to the parties entitled thereto, of all\n\ncharges which such company may collect or receive, pending the\n\nappeal, in excess of those fixed or authorized by the order of the\n\nCommission violated or disregarded by such corporation, person or\n\nfirm. Such bond shall be conditioned to require such corporation,\n\nperson or firm to keep such accounts and to make to the Commission\n\nfrom time to time such report, verified by oath, as may in the\n\njudgment of the Commission suffice to show the amount being charged\n\nor received by the company pending the appeal, in excess of the\n\ncharge prescribed by the Commission in the order violated, together\n\nwith the names and addresses of persons to whom such overcharges\n\nwill be refunded in case the charges made by the company pending the\n\nappeal be not sustained on the final judgment, and the commission\n\nmay at any time require such corporation, person or firm to give\n\nadditional security or to increase the suspending bond when the same\n\nmay appear to the Commission to be necessary to insure the prompt\n\nrefunding of the overcharges aforesaid. Upon the final judgment, if\n\nthe order violated is sustained in the Supreme Court, the Commission\n\nshall distribute such overcharges to the persons to whom the same\n\nare due, as provided in Section twenty-one, Article nine, of the\n\nConstitution: Provided, that if the order violated is one fixing or\n\nestablishing rates and the corporation, person or firm shall obey\n\nsuch order and carry its provisions into effect pending such appeal,\n\nthe last above-mentioned bond shall not be required.","path":["OK Code","Title 17"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os17.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"3d86722a79f522f8e629351cc23d6b297b2469be09309364987632261f44ba09","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-17-17-39.2","next":"us-ok/okla.-stat.-tit.-17-17-40"},"notice":"GroundRules: Original legal text.
