Stat. tit. 17, § 17-43","heading":"Matters considered in issuing license - Existing gins -","body":"Showing to obtain license - Cooperative gins - Inspectors.\n\nThe Corporation Commission in issuing such license shall have\n\nthe right to take into consideration the necessity for the operation\n\nof a gin for such purpose at the place of its location; provided\n\nnothing herein shall operate to prevent the licensing of gins now\n\nestablished, except for violation of the provisions of this act or\n\nof the rules, regulations, and requirements of the Corporation\n\nCommission made and promulgated pursuant to this act. No new gin\n\nplants shall be constructed, installed, or licensed, or any old gin\n\nremoved from one point to another until satisfactory showing shall\n\nhave been made to the Corporation Commission setting forth that such\n\ngin is a needed utility and that the proposed corporation, company,\n\nfirm or individual is a competent and desirable corporation,\n\ncompany, firm or individual to establish and operate said gin as may\n\nappear in the discretion of said commission; provided, that on the\n\npresentation of a petition for the establishment of a gin to be run\n\ncooperatively, signed by one hundred (100) citizens and tax payers\n\nof the community where the gin is to be located, the Corporation\n\nCommission shall issue a license for said gin. The commission shall\n\nhave the right to take into consideration the responsibility and\n\nreliability and qualifications as well as the capacity of the person\n\nor persons or corporation to do such ginning business so far as to\n\nafford all reasonable facilities, conveniences and services to the\n\npublic and shall have the power and authority to require such\n\nfacilities, conveniences and services to be afforded the public. The\n\ninspectors provided herein shall be men who have served at least\n\nthree (3) years in practical and actual gin operation and shall be\n\nappointed by the Corporation Commission; that said inspectors shall\n\nhave the power to make recommendations to the commission as to the\n\nopening or closing of any gin or gins as well as to the affording by\n\nsuch gins of the reasonable facilities, conveniences and services to\n\nthe public hereinbefore authorized to be required, as well as to\n\nmake such other reports and recommendations to the Corporation\n\nCommission as may to said inspectors appear necessary, reasonable\n\nand just.","path":["OK Code","Title 17"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os17.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"e70ea285061da10cb0d2e2c1f1d894a9b40c4e73b4258a65fd8de5276bf77e25","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-17-17-42","next":"us-ok/okla.-stat.-tit.-17-17-44"},"notice":"GroundRules: Original legal text.
