The Corporation Commission is hereby vested with\n\njurisdiction over:\n\n1. The drilling for and production of brine for commercial\n\npurposes;\n\n2. Class V injection wells used for the injection or disposal\n\nof mineral brines as defined in the federal Safe Drinking Water Act\n\nand 40 CFR Part 146; and\n\n3. Class V wells used to inject spent brine into the same\n\nformation from which it was withdrawn after extraction of halogens\n\nor their salts as defined in 40 CFR Part 146.\n\nB. The Commission may promulgate such rules:\n\n1. As are reasonably necessary to effectuate the purposes of\n\nthis act, including rules governing the drilling of production,\n\ninjection or disposal wells and the injection of effluent into\n\nunderground formations; and\n\n2. To ensure that the drilling, casing and plugging of wells is\n\ndone in such a manner as to prevent the escape of brine and effluent\n\nfrom one formation to another and to prevent the pollution of fresh\n\nwater supplies throughout the state.\n\nC. The Oklahoma Brine Development Act shall not apply to nor\n\nshall the Corporation Commission have jurisdiction over Class I,\n\nIII, IV or V wells regulated by the Department of Environmental\n\nQuality pursuant to the federal Safe Drinking Water Act and 40 CFR\n\nParts 144 through 148, inclusive, and the Oklahoma Environmental\n\nQuality Act.","path":["OK Code","Title 17"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os17.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"5ba862538369faaa74d5b4732b00a6c6653fdfb740326848d1c4445a8cd6f593","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-17-17-502","next":"us-ok/okla.-stat.-tit.-17-17-504"},"notice":"GroundRules: Original legal text.
