Stat. tit. 17, § 17-608","heading":"Corporation Commission - Jurisdiction over sales of","body":"compressed natural gas - Notice of price increases - Hearing.\n\nA. The Corporation Commission shall have jurisdiction over all\n\nsales in this state of compressed natural gas to the state or any\n\ncounty, municipality or public trust authority located within this\n\nstate, the State Department of Education or any school district\n\nwithin this state, if the compressed natural gas is utilized in a\n\ngovernment vehicle or a school vehicle as defined in Section 2 of\n\nthis act.\n\nB. Any entity engaged in the sale of compressed natural gas, in\n\nthe manner specified in subsection A of this section, and not\n\notherwise determined to be a public utility pursuant to Section 151\n\nof this title, shall be required to give notice to the Commission\n\nprior to increasing the price of compressed natural gas more than\n\nfive percent (5%). The Commission shall either approve the increase\n\nwithin five (5) business days of the notification or notify the\n\nentity of the suspension of the price increase pending further\n\ninvestigation of such increase. The Commission shall give notice\n\nand conduct hearings concerning such price increases as the\n\nCommission deems appropriate and the Commission shall notify the\n\nAttorney General of the time and place any such hearings are to be\n\nheld. In determining whether the increase should be granted, the\n\nCommission shall consider:\n\n1. the costs of the entity to provide the compressed natural\n\ngas;\n\n2. the availability of alternate fuel supplies to consumers;\n\nand\n\n3. the potential impact of the proposed increase on the\n\navailability of compressed natural gas.\n\nAny public utility engaged in the sale of compressed natural gas in\n\nthe manner specified in subsection A of this section shall not sell\n\nsuch compressed natural gas at a price greater than the applicable\n\ntariff rate for commercial customers of such public utility plus the\n\ncosts of compressing such gas.\n\nC. Notice to the Commission shall be given by filing a verified\n\nstatement with the Director of the Public Utility Division which\n\nsets forth:\n\n1. the name and address of the entity;\n\n2. the current price and the proposed price;\n\n3. documentation which supports the need for the increase; and\n\n4. the proposed date of the increased price.\n\nD.
