The Oklahoma Low Carbon Energy Initiative shall be\n\nadministered and governed by the Oklahoma Low Carbon Energy\n\nInitiative Board, made up of representatives of the contributing\n\ninstitutions and entities of the Initiative which shall include but\n\nnot be limited to the University of Oklahoma, Oklahoma State\n\nUniversity, and the University of Tulsa. Additional contributing\n\nmembers may be added at the discretion of the Board, if they\n\ncontribute to the purpose, objectives, and research coordinated by\n\nthe Initiative.\n\nB. The Board shall consist of thirteen (13) members as follows:\n\n1. One member, who shall serve as the chair of the Board, shall\n\nbe the Secretary of Energy and Environment or a member otherwise\n\nappointed by the Governor;\n\n2. One member shall be the Vice President for Research from the\n\nUniversity of Oklahoma or a member otherwise appointed by the\n\nPresident of the University of Oklahoma;\n\n3. One member shall be the Vice President for Research from\n\nOklahoma State University or a member otherwise appointed by the\n\nPresident of Oklahoma State University;\n\n4. One member shall be the Vice President for Research and\n\nEconomic Development from the University of Tulsa or a member\n\notherwise appointed by the President of the University of Tulsa;\n\n5. One member who shall represent the Oklahoma Department of\n\nCommerce, appointed by the Director of the Department of Commerce;\n\n6. One member who shall represent the Department of Labor,\n\nappointed by the Commissioner of Labor;\n\n7. One member who shall represent the Department of\n\nEnvironmental Quality, appointed by the Executive Director of the\n\nDepartment of Environmental Quality;\n\n8. One member who shall represent the Corporation Commission,\n\nappointed by the Chair of the Commission;\n\n9. One member who shall represent the Department of\n\nTransportation, appointed by the Director of the Department of\n\nTransportation;\n\n10. One member who shall represent the Oklahoma Water Resources\n\nBoard, appointed by the Executive Director of the Oklahoma Water\n\nResources Board;\n\n11. One member who shall represent the Oklahoma Center for the\n\nAdvancement of Science and Technology, appointed by the Executive\n\nDirector of the Center for the Advancement of Science and\n\nTechnology;\n\n12. One member, who shall represent an electric utility or\n\ncooperative regulated by the Corporation Commission, appointed by\n\nthe President Pro Tempore of the Senate; and\n\n13. One member, who shall represent the nuclear energy\n\nindustry, appointed by the Speaker of the House of Representatives.\n\nC. 1. The Board shall establish an Energy Industry Advisory\n\nCouncil, appointed by the chair, for the purposes of providing\n\nindustry expertise and knowledge, assisting the Board with annual\n\nreport requirements, providing general recommendations, and other\n\nsupport as needed to advance the efforts of the Board.\n\n2. Members appointed to the Council shall serve at the pleasure\n\nof the chair of the Board.\n\nD. Board members shall serve for a term of four (4) years,\n\nwhich shall begin on January 1 of the first year of the appointment\n\nand end on December 31 of the fourth year. There shall be no limit\n\nto the number of consecutive terms served. If a vacancy should\n\noccur during a member’s term, the appointing authority for the\n\nvacant position shall appoint a new member to fill the remainder of\n\nthe unexpired term. Board members shall serve without compensation\n\nbut may be eligible for necessary travel expenses pursuant to the\n\nState Travel Reimbursement Act.\n\nE. The Board shall be responsible for establishing procedures\n\nfor the Initiative and operations of the Board and the Advisory\n\nCouncil. The rules may provide for protection from public\n\ndisclosure of trade secrets and proprietary information of any kind\n\nincluding, but not limited to, data, processes and technology, as\n\nthe Board determines necessary.\nuant to the\n\nState Travel Reimbursement Act.\n\nE. The Board shall be responsible for establishing procedures\n\nfor the Initiative and operations of the Board and the Advisory\n\nCouncil. The Board shall undertake activities and commission\n\nprograms, through the contributing institutions and entities, to\n\nachieve the purpose and satisfy the objectives of the Initiative as\n\nprovided in the Oklahoma Energy Initiative Act. The Board shall\n\nhave authority to distribute funding for such activities and\n\nprograms. The Board may employ staff as it deems necessary.\n\nG. The Board, in consultation with the Advisory Council and any\n\nother party deemed necessary, shall submit and publish\n\nelectronically an annual, written report to summarize the annual\n\nprogress of the Initiative including summaries of its programs and\n\ntheir progress and outcomes. The report shall be made available to\n\nthe public and shall be distributed electronically to the Governor,\n\nthe President Pro Tempore of the Senate, and the Speaker of the\n\nHouse of Representatives.\n\nH. The provisions of the Oklahoma Central Purchasing Act shall\n\nnot apply to any project, activity or contract of the Initiative or\n\nthe Board.\n\nI. No Board member or any person acting on behalf of the Board,\n\nAdvisory Council, or Initiative executing any contracts, commitments\n\nor agreements issued by or on behalf of the Oklahoma Low Carbon\n\nEnergy Initiative shall be personally liable for the contracts,\n\ncommitments, or agreements or be subject to any personal liability\n\nor accountability by reason thereof.
