Not later than ninety (90) days after the effective date of\n\nthis act, the Corporation Commission shall start the process to\n\nengage an outside consulting firm to conduct a technical and legal\n\nfeasibility study on nuclear energy generation in this state. This\n\nengagement shall be exempt from the state procurement process under\n\nSection 85.1 et seq. of Title 74 of the Oklahoma Statutes and follow\n\nthe Corporation Commission process to retain expert witnesses on\n\nbehalf of the agency to ensure the ability to timely conduct the\n\nstudy and complete the requirements of this section. The consulting\n\nfirm shall be well-established in the nuclear industry.\n\nB. The feasibility study shall evaluate and consider:\n\n1. Advantages and disadvantages of generating nuclear energy in\n\nthis state, including, but not limited to, the economic and\n\nenvironmental impacts;\n\n2. Methods to maximize existing workforce and products made in\n\nthis state for the construction of nuclear energy generation\n\nfacilities;\n\n3. Design characteristics, including recommendations for design\n\nspecification and site selection;\n\n4. Environmental and ecological impacts;\n\n5. Land and siting criteria, including specific geographic\n\nareas that are best suited for new nuclear generation, as well as\n\ncities near military bases that may use new nuclear electric\n\ngeneration to meet the military resiliency requirements of 10\n\nU.S.C., Section 2920;\n\n6. Safety criteria;\n\n7. Engineering and cost-related information;\n\n8. Small modular nuclear reactor and microreactors capability;\n\nand\n\n9. Socioeconomic factors, including, but not limited to:\n\na. workforce education, training, and development,\n\nb. local and state tax base,\n\nc. supply chain capability,\n\nd. permanent and temporary job creation,\n\ne. timeline for development, including areas of potential\n\nefficiencies, and potential leveraging of existing\n\nfacilities within this state,\n\nf. literature review of studies that have assessed the\n\npotential impact of nuclear energy generation, and\n\ng. policy recommendations to support nuclear energy\n\ngeneration, including a survey of federal programs to\n\nfinancially assist the development of a nuclear\n\nproject in this state.\n\nC. The Corporation Commission in conjunction with retail\n\nelectric suppliers and municipally owned electric utilities shall\n\ncooperate in providing information relevant to the feasibility\n\nstudy, providing for reasonable safeguards to protect confidential\n\ninformation.\n\nD. Not later than nine (9) months after the effective date of\n\nthis act, the Corporation Commission shall electronically deliver\n\nthe feasibility study findings to the President Pro Tempore of the\n\nOklahoma State Senate, the Speaker of the Oklahoma House of\n\nRepresentatives, and the Governor.\n\nE. In the event the Corporation Commission is unable to hire a\n\nconsultant to complete the report, the Commission is authorized to\n\nconduct a notice of inquiry and utilize the information received\n\nfrom the stakeholders in conjunction with a consulting firm to\n\nreduce the cost of gathering information for the purpose of the\n\nstudy and report.","path":["OK Code","Title 17"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os17.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"6f8494e3e005a13e26bbf721d7f4e3a174593c1f99711b3f2c059f41627a9985","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-17-17-802.4","next":"us-ok/okla.-stat.-tit.-17-17-81"},"notice":"GroundRules: Original legal text.
