Stat. tit. 18, § 18-381.24d","heading":"Consumer banking electronic facilities - Assistance in","body":"operation of facility - Access - Authority of federal savings\n\nassociations.\n\nA. Any association may install, operate or utilize consumer\n\nbanking electronic facilities, provided written notice is given to\n\nthe State Banking Commissioner prior to the commencement of\n\noperations of each facility. Such notice shall contain any\n\nreasonable descriptive information pertaining to the facility as\n\nshall be required by the rules or regulations of the Commissioner.\n\nB. A consumer banking electronic facility, when located other\n\nthan at an association's main office or detached facility, may be\n\noperated exclusively by association customers or transactions may be\n\nperformed through the assistance of any person provided that person\n\nis not employed, either directly or indirectly, by any association,\n\nassociation holding company or subsidiary thereof. Such assistance\n\nshall not be deemed to be engaging in association business. Persons\n\nassisting association customers at the site of a consumer banking\n\nelectronic facility may be trained by association employees and\n\nnothing in this section shall be construed to prohibit periodic\n\nservicing of a consumer banking electronic facility by an\n\nassociation employee. Under no circumstances may an employee of an\n\nassociation, association holding company, affiliate or subsidiary\n\nthereof perform transactions for others at the consumer banking\n\nelectronic facility. However, a consumer banking electronic\n\nfacility located on the business premises of a person engaged in the\n\nsale of goods or services may be used to perform internal nonbanking\n\nfunctions for such persons.\n\nC. Consumer banking electronic facility transactions shall be\n\nconsidered as the conduct of association transactions at the main\n\noffice of the association for which the data is transmitted.\n\nD. 1. An association or combination of associations or\n\nbusiness entity or organization offering such services to an\n\nassociation which establishes or maintains a manned or unmanned\n\nconsumer banking electronic facility or facilities shall make the\n\nuse thereof available to associations located in this state on a\n\nfair and equitable basis of nondiscriminatory access and rates.\n\nProvided, that if a retailer does accept any credit or debit card or\n\nother system, nothing herein shall be construed to deprive such\n\nretailer of the right to accept or reject any other credit or debit\n\ncard or other system offered by any other association or business\n\nentity.\n\n2. An association or combination of associations which\n\nestablishes and maintains a manned consumer banking electronic\n\nfacility or facilities may make the use thereof available on a\n\nreciprocal basis to banks and credit unions located in this state on\n\na fair and equitable basis of nondiscriminatory access and rates.\n\n3. In the event of a dispute, the Commissioner shall have the\n\njurisdiction to determine, after a hearing conducted upon notice and\n\npursuant to regulations adopted by the Commissioner, what\n\nconstitutes a fair and equitable basis of nondiscriminatory access\n\nand rates, based upon cost of installation and proportionate usage\n\nof the facility. A principal factor in any equitable formula of\n\nshared costs of installation and/or operation shall give weight to\n\nthe number of transactions of each participating association.\n\n4. Proceedings under this section shall be subject to Article\n\nII of the Administrative Procedures Act, Section 309 et seq. of\n\nTitle 75 of the Oklahoma Statutes.\n\nE.
