Stat. tit. 18, § 18-381.53b","heading":"Impairment of permanent capital stock - Notice -","body":"Appraisals - Assessments.\n\nA. If the State Banking Commissioner, as a result of any\n\nexamination or from any report made to the Commissioner, finds that\n\nthe permanent capital stock of any association is impaired, the\n\nCommissioner shall notify the association that such impairment\n\nexists and require the association to immediately make good such\n\nimpairment. After such notice has been given to an association and\n\nuntil the impairment has been made good, that association may not\n\nissue or renew any time instrument if that instrument, when\n\naggregated with any other funds of the same depositor in the same\n\ncapacity, would equal or exceed One Hundred Thousand Dollars\n\n($100,000.00) unless such time instrument earns an annual rate of\n\ninterest less than four percent (4%). In the event the amount of\n\nthe impairment as determined by the Commissioner is questioned by\n\nthe association, then upon application, which shall be filed within\n\nten (10) days, the value of the assets in question shall be\n\ndetermined by appraisals made by independent appraisers acceptable\n\nto the Commissioner and the association.\n\nB. The directors of the association, upon which such notice has\n\nbeen made, shall levy a pro rata assessment upon the permanent\n\ncapital stock thereof to make good such impairment and shall cause\n\nnotice of such request of the Commissioner and such levy to be given\n\nin writing to each stockholder of such association and the amount of\n\nassessment which the stockholder must pay for the purpose of making\n\nsuch assessment.","path":["OK Code","Title 18"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os18.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"c550cb74fffd4e0a54c5966c17763208a1681517a85c601b312e0f0a0e52ba2a","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-18-18-381.53a","next":"us-ok/okla.-stat.-tit.-18-18-381.53c"},"notice":"GroundRules: Original legal text.
