Stat. tit. 18, § 18-441-1302","heading":"Proper plaintiff","body":"PROPER PLAINTIFF.\n\n(a) A derivative action to enforce a right of a limited\n\ncooperative association may be maintained only by a person that:\n\n(1) Is a member or a dissociated member at the time the action\n\nis commenced and:\n\n(A) was a member when the conduct giving rise to the\n\naction occurred; or\n\n(B) whose status as a member devolved upon the person by\n\noperation of law or the organic rules from a person\n\nthat was a member at the time of the conduct; and\n\n(2) Adequately represents the interests of the association.\n\n(b) If the sole plaintiff in a derivative action dies while the\n\naction is pending, the court may permit another member who meets the\n\nrequirements of subsection (a) of this section to be substituted as\n\nplaintiff.","path":["OK Code","Title 18"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os18.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"ac71350f29a6820e3143185cf791cd6f09c8ab9807a593e3b5943f14d31ba333","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-18-18-441-1301","next":"us-ok/okla.-stat.-tit.-18-18-441-1303"},"notice":"GroundRules: Original legal text.
