Stat. tit. 18, § 18-441-505","heading":"Right of member and former member to information","body":"RIGHT OF MEMBER AND FORMER MEMBER TO INFORMATION.\n\n(a) Not later than ten (10) business days after receipt of a\n\ndemand made in a record, a limited cooperative association shall\n\npermit a member to obtain, inspect, and copy in the association’s\n\nprincipal office required information listed in paragraphs (1)\n\nthrough (8) of subsection (a) of Section 14 of this act during\n\nregular business hours. A member need not have any particular\n\npurpose for seeking the information. The association is not\n\nrequired to provide the same information listed in paragraphs (2)\n\nthrough (8) of subsection (a) of Section 14 of this act to the same\n\nmember more than once during a six-month period.\n\n(b) On demand made in a record received by the limited\n\ncooperative association, a member may obtain, inspect, and copy in\n\nthe association’s principal office required information listed in\n\nparagraphs (9), (10), (12), (13), (16) and (18) of subsection (a) of\n\nSection 14 of this act during regular business hours, if:\n\n(1) The member seeks the information in good faith and for a\n\nproper purpose reasonably related to the member’s interest;\n\n(2) The demand includes a description with reasonable\n\nparticularity of the information sought and the purpose for seeking\n\nthe information;\n\n(3) The information sought is directly connected to the\n\nmember’s purpose; and\n\n(4) The demand is reasonable.\n\n(c) Not later than ten (10) business days after receipt of a\n\ndemand pursuant to subsection (b) of this section, a limited\n\ncooperative association shall provide, in a record, the following\n\ninformation to the member that made the demand:\n\n(1) If the association agrees to provide the demanded\n\ninformation:\n\n(A) what information the association will provide in\n\nresponse to the demand; and\n\n(B) a reasonable time and place at which the association\n\nwill provide the information; or\n\n(2) If the association declines to provide some or all of the\n\ndemanded information, the association’s reasons for declining.\n\n(d) A person dissociated as a member may obtain, inspect, and\n\ncopy information available to a member under subsection (a) or (b)\n\nof this section by delivering a demand in a record to the limited\n\ncooperative association in the same manner and subject to the same\n\nconditions applicable to a member under subsection (b) of this\n\nsection if:\n\n(1) The information pertains to the period during which the\n\nperson was a member in the association; and\n\n(2) The person seeks the information in good faith.\n\n(e) A limited cooperative association shall respond to a demand\n\nmade pursuant to subsection (d) of this section in the manner\n\nprovided in subsection (c) of this section.\n\n(f) Not later than ten (10) business days after receipt by a\n\nlimited cooperative association of a demand made by a member in a\n\nrecord, but not more often than once in a six-month period, the\n\nassociation shall deliver to the member a record stating the\n\ninformation with respect to the member required by paragraph (17) of\n\nsubsection (a) of Section 14 of this act.\n\n(g) A limited cooperative association may impose reasonable\n\nrestrictions, including nondisclosure restrictions, on the use of\n\ninformation obtained under this section. In a dispute concerning\n\nthe reasonableness of a restriction under this subsection, the\n\nassociation has the burden of proving reasonableness.\n\n(h) A limited cooperative association may charge a person that\n\nmakes a demand under this section reasonable costs of copying,\n\nlimited to the costs of labor and material.\n\n(i) A person that may obtain information under this section may\n\nobtain the information through an attorney or other agent. A\n\nrestriction imposed on the person under subsection (g) of this\n\nsection or by the organic rules applies to the attorney or other\n\nagent.\n\n(j) The rights stated in this section do not extend to a person\n\nas transferee.\n.\n\n(i) A person that may obtain information under this section may\n\nobtain the information through an attorney or other agent.
