Stat. tit. 18, § 18-552.2","heading":"Definitions","body":"As used in the Oklahoma Solicitation of Charitable Contributions\n\nAct:\n\n1. \"Person\" means any individual, organization, group,\n\nassociation, partnership, corporation, limited liability company,\n\ntrust, or other entity, except as otherwise provided in Section\n\n552.1 et seq. of this title;\n\n2. \"Charitable organization\" means any person soliciting\n\ncontributions in this state, other than a natural person, that is\n\ndescribed in Section 501(c) of Title 26 of the United States Code,\n\nthat solicits contributions as described in this act and that is\n\norganized and operated primarily for religious, charitable,\n\nscientific, literary, educational, artistic, cultural, economic\n\ndevelopment, civic improvement, testing for public safety, research,\n\nhumanitarian, animal welfare, recreational, or environmental\n\nprotection purposes; to foster national or international amateur\n\nsports competition, but only if no part of its activities involves\n\nthe provision of athletic facilities or equipment; to prevent\n\ncruelty to children, the elderly, identified populations, or\n\nanimals; to relieve poverty, hunger, or homelessness; to support law\n\nenforcement or citizen protection organizations or agencies; or to\n\nprovide emergency relief. \"Charitable organization\" shall also\n\ninclude a natural person representing himself or herself as a\n\ncharitable organization or purporting to act on behalf of a\n\ncharitable organization;\n\n3. \"Contribution\" means the promise, gift, donation, payment,\n\npledge, or grant of any money or property of any kind or value,\n\nincluding any contribution for operations, capital, endowment,\n\nreserves, dues, memberships, program support, naming opportunities,\n\nor other uses. Contribution does not include a payment for goods,\n\nservices, admission to a museum, performances or programs sold or\n\nprovided by a charitable organization, if the payment does not\n\nexceed the bona fide fair market value of the goods or services\n\nprovided;\n\n4. \"Professional fundraiser\" means any person who for\n\ncompensation or other consideration plans, conducts or manages in\n\nthis state the solicitation of contributions for or on behalf of any\n\ncharitable organization, or who engages in the business of or holds\n\nhimself or herself out to persons in this state as independently\n\nengaged in the business of soliciting contributions for such\n\npurpose. For purposes of this act, professional fundraiser does not\n\ninclude an employee of a charitable organization who engages in such\n\nactivities for the charitable organization for which he or she is\n\nemployed; nor does it include any volunteer who receives no payment,\n\ncompensation, or remuneration of any kind for soliciting any\n\ncontributions; provided, a volunteer may receive credit for\n\nfulfilling any community service requirement of an educational\n\ninstitution or government agency. In addition, for this purpose\n\nconsideration does not include incidental benefits that might be\n\nreceived by a noncompensated person, such as meals, supplies, or\n\nsimilar support, and does not include reimbursement for expenses\n\nincurred by any noncompensated person in his or her solicitation\n\nactivities;\n\n5. \"Professional solicitor\" means any person that is either\n\nlocated within this state or that is soliciting contributions from\n\nany person in this state and who is employed or retained for\n\ncompensation or other consideration by a professional fundraiser to\n\nsolicit contributions for or on behalf of any charitable\n\norganization. Professional solicitor does not include an employee\n\nof a charitable organization who is engaged in such activities for\n\nthe charitable organization for which he or she is employed; nor\n\ndoes it include a volunteer who engages in such activities for the\n\ncharitable organization for which he or she volunteers if the\n\nvolunteer receives no payment, compensation or remuneration of any\n\nkind for soliciting any contributions; provided, a volunteer may\ne\n\nof a charitable organization who is engaged in such activities for\n\nthe charitable organization for which he or she is employed; nor\n\ndoes it include a volunteer who engages in such activities for the\n\ncharitable organization for which he or she volunteers if the\n\nvolunteer receives no payment, compensation or remuneration of any\n\nkind for soliciting any contributions; provided, a volunteer may\n\nreceive credit for fulfilling any community service requirement of\n\nan educational institution or government agency. In addition, for\n\nthis purpose consideration does not include incidental benefits that\n\nmight be received by a noncompensated person, such as meals,\n\nsupplies, or similar support, and does not include reimbursement for\n\nexpenses incurred by any noncompensated person in his or her\n\nsolicitation activities;\n\n6. \"Professional fundraising counsel\" means any person that\n\nprovides, for compensation or other consideration, services,\n\nincluding planning, organizing or managing any solicitation, to a\n\ncharitable organization, as long as such person does not:\n\na. directly or indirectly solicit contributions alone or\n\nthrough its employees and agents, or\n\nb. accept, receive, hold, have access to, maintain,\n\nmanage, invest, or control any contribution generated\n\nby the solicitation activity.\n\nHowever, professional fundraising counsel does not include an\n\nemployee or volunteer of a charitable organization who is providing\n\nsuch services on behalf of the charitable organization;\n\n7. \"Solicitation\" means the request or appeal for any\n\ncontribution on the plea or representation that such contribution\n\nwill be used by or on behalf of a charitable organization; and\n\n8. \"Form 990\" means a return of an organization that is exempt\n\nfrom federal income tax.
