Stat. tit. 18, § 18-552.3","heading":"Registration - Fee - Information to be filed - Out-of-","body":"state organizations.\n\nA. No charitable organization that is either located within\n\nthis state or that is soliciting contributions from any person in\n\nthis state, except those specifically exempt under Section 552.4 of\n\nthis title, shall solicit contributions until the charitable\n\norganization shall have registered with the Office of the Secretary\n\nof State and filed information, as required by the Oklahoma\n\nSolicitation of Charitable Contributions Act, on forms approved by\n\nthat office. At the time of registration, each charitable\n\norganization, except as otherwise provided in this section, shall\n\npay a fee of Sixty-five Dollars ($65.00). The first Fifteen Dollars\n\n($15.00) of the fee shall be deposited to the credit of the General\n\nRevenue Fund of the State Treasury. Thirty-four Dollars ($34.00) of\n\nthe fee shall be deposited to the credit of the Attorney General\n\nCharitable Solicitations Enforcement Revolving Fund and the\n\nremaining Sixteen Dollars ($16.00) shall be deposited to the credit\n\nof the Secretary of State Charitable Solicitations Revolving Fund.\n\nProvided, a charitable organization whose contributions during the\n\nprevious registration period did not exceed Ten Thousand Dollars\n\n($10,000.00) or if this is the charitable organization's first\n\nregistration period and the anticipated contributions for the\n\ncurrent registration period are not expected to exceed Ten Thousand\n\nDollars ($10,000.00), shall pay a fee of Fifteen Dollars ($15.00) of\n\nwhich Ten Dollars ($10.00) shall be deposited to the credit of the\n\nAttorney General Charitable Solicitations Enforcement Revolving Fund\n\nand the remaining Five Dollars ($5.00) shall be deposited to the\n\ncredit of the Secretary of State Charitable Solicitations Revolving\n\nFund. Each charitable organization that is required to register\n\nunder this act shall register annually with the Secretary of State\n\nby the date that the charitable organization files its Form 990 or\n\nby the date, plus extensions, that it is required to file its Form\n\n990, whichever occurs first. Registration shall not be deemed to\n\nconstitute an endorsement by the state or by the Secretary of State\n\nof any charitable organization or the proposed uses of the funds\n\nsolicited. The information so filed shall be available to the\n\ngeneral public. The charitable organization shall provide the\n\nfollowing information on the required forms:\n\n1. The legal name of the charitable organization, any trade\n\nnames that the charitable organization uses, any other name the\n\norganization may be identified or known as, and any distinctive\n\nnames the organization uses for purposes of solicitation of\n\ncontributions;\n\n2. The mailing address of the charitable organization;\n\n3. The name and mailing address of:\n\na. each officer, director, trustee, and/or equivalent, and\n\nb. each salaried executive employee of the charitable\n\norganization;\n\n4. The name and mailing address of:\n\na. each professional fundraiser or professional solicitor\n\nthat will have custody of the contributions, and\n\nb. each person associated with a professional fundraiser,\n\nprofessional solicitor or charitable organization that\n\nis directly responsible for the payment and\n\ndistribution of funds collected;\n\n5. The name and mailing address of each professional\n\nfundraising counsel utilized by the charitable organization;\n\n6. For charitable organizations that register for the first\n\ntime, a statement of whether or not the charitable organization\n\nbelieves contributions for the first year of registration will\n\nexceed Ten Thousand Dollars ($10,000.00);\n\n7. The purposes for which the contributions solicited are to be\n\nused;\n\n8. For the initial registration of a newly formed charitable\n\norganization, a copy of a letter from the Internal Revenue Service,\n\nor other evidence, showing that such organization is exempt from\n\nfederal income taxation; or, for a charitable organization that has\nf registration will\n\nexceed Ten Thousand Dollars ($10,000.00);\n\n7. The purposes for which the contributions solicited are to be\n\nused;\n\n8. For the initial registration of a newly formed charitable\n\norganization, a copy of a letter from the Internal Revenue Service,\n\nor other evidence, showing that such organization is exempt from\n\nfederal income taxation; or, for a charitable organization that has\n\nnot applied for federal income tax exemption with the Internal\n\nRevenue Service or is not required to apply for federal income tax\n\nexemption, evidence showing that said charitable organization is\n\norganized in any state or jurisdiction as a not-for-profit entity;\n\n9. An identification of the period of time or periods during\n\nwhich solicitations are to be conducted, which may be specific\n\nperiods, estimated or projected time frames, or continuous, and\n\nwhich may involve different periods for different types of\n\nsolicitations by the same charitable organization;\n\n10. An identification of the specific method or methods of\n\nsolicitation utilized by the charitable organization and its agents;\n\n11. Whether the solicitation is to be conducted by the\n\nfollowing for or on behalf of the charitable organization:\n\nprofessional fundraisers, employees or volunteers of the charitable\n\norganization, and/or others; and\n\n12. If the solicitation is to be conducted in whole or in part\n\nby professional fundraisers, the names and addresses of each\n\nprofessional fundraiser involved in the solicitation; the basis of\n\npayment or other consideration payable to each professional\n\nfundraiser and the nature of the arrangements between the charitable\n\norganization and each professional fundraiser, the specific amount,\n\nformula or percentage of compensation, or property of any kind or\n\nvalue to be paid or provided to each professional fundraiser; and if\n\npayment is based on a percentage, the amount of compensation as a\n\npercentage of the total contributions received, and the net amount\n\nof the total contributions received (total contributions received,\n\nless expenses of solicitation other than amounts payable to any\n\nprofessional fundraiser).\n\nB. In addition to the required information in subsection A of\n\nthis section, every charitable organization subject to the\n\nprovisions of the Oklahoma Solicitation of Charitable Contributions\n\nAct that has solicited contributions during the previous fiscal year\n\nshall provide the following information:\n\n1. The gross amount of the contributions, gifts, grants and\n\nother similar amounts received by the charitable organization;\n\n2. The total Program Service Expenses of the charitable\n\norganization;\n\n3. The total Management and General Expenses of the charitable\n\norganization;\n\n4. The total Fundraising Expenses of the charitable\n\norganization; and\n\n5. The aggregate amount paid, or payable, to professional\n\nfundraisers and professional fundraising counsel.\n\nC. Any registration form required to be filed under this\n\nsection shall be executed by signature, without more, of the person\n\nor persons signing the form, in which case the signature or\n\nsignatures shall constitute the affirmation of the signatory, under\n\npenalty of perjury, that the signature is that person's act and deed\n\nor the act and deed of the organization, and that the facts stated\n\ntherein are true.\n\nD. If a charitable organization that is registered with the\n\nSecretary of State to solicit contributions in this state changes\n\nits name or the mailing address of its principal office, or plans to\n\nengage in the solicitation of contributions using a name that is not\n\nlisted on its registration form, then it shall, prior to soliciting\n\nany funds in this state using any such name, file with the Secretary\n\nof State a statement executed by an authorized officer of the\n\norganization setting forth any new name and mailing address along\ne or the mailing address of its principal office, or plans to\n\nengage in the solicitation of contributions using a name that is not\n\nlisted on its registration form, then it shall, prior to soliciting\n\nany funds in this state using any such name, file with the Secretary\n\nof State a statement executed by an authorized officer of the\n\norganization setting forth any new name and mailing address along\n\nwith a fee of Twenty-five Dollars ($25.00). Such fee shall be\n\ndeposited to the credit of the General Revenue Fund of the State\n\nTreasury.\n\nE. Any fraternal or membership organization not based in\n\nOklahoma which solicits contributions from any person of this state\n\nby telephone, or contracts with professional fundraisers to solicit\n\nsuch contributions, shall be required to have at least one member or\n\nemployee of the fraternal or membership organization residing within\n\nthe county where the call is received.","path":["OK Code","Title 18"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os18.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"c931966b89a8bcd16ec1d130afc4402b498f25910f3c8955665a9836b9e71581","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-18-18-552.24","next":"us-ok/okla.-stat.-tit.-18-18-552.4"},"notice":"GroundRules: Original legal text.
