No person shall act as a professional fundraiser for any\n\ncharitable organization until the person has first registered with\n\nthe Office of the Secretary of State. Applications for\n\nregistration, signed and acknowledged by a party duly authorized to\n\nact on behalf of the professional fundraiser, shall state the full\n\nlegal name of the professional fundraiser, the street address of the\n\nprincipal place of business of the professional fundraiser, the full\n\nlegal names and street addresses of the charitable organizations\n\nwith which it has entered into contracts or agreements relating to\n\nthe solicitation of contributions, and the names of all professional\n\nsolicitors employed by the professional fundraiser who will be\n\ninvolved in the solicitation of contributions for charitable\n\norganizations. The registration form shall also be accompanied by\n\nan annual fee in the amount of Two Hundred Fifteen Dollars\n\n($215.00). The first Fifty Dollars ($50.00) of the fee collected\n\nshall be deposited to the credit of the General Revenue Fund of the\n\nState Treasury. One Hundred Eleven Dollars ($111.00) of the fee\n\nshall be deposited to the credit of the Attorney General Charitable\n\nSolicitations Enforcement Revolving Fund and the remaining Fifty-\n\nfour Dollars ($54.00) shall be deposited to the credit of the\n\nSecretary of State Charitable Solicitations Revolving Fund.\n\nRegistration shall be valid for a period of one (1) year from the\n\ndate of filing with the Secretary of State, and may be renewed\n\nannually upon the filing of a renewal application and fee prescribed\n\nherein.\n\nB. No professional fundraiser or solicitor shall engage in the\n\nsolicitation of contributions for a charitable organization that is\n\nnot registered with the Secretary of State unless the organization\n\nis exempt from registration.\n\nC. Every professional fundraiser registered with the Secretary\n\nof State which shall change its name or the mailing address of its\n\nprincipal office, or plans to engage in professional fundraising\n\nactivities using a name that is not listed on its registration form,\n\nshall at least fifteen (15) days prior to engaging in such\n\nactivities file with the Secretary of State a statement executed by\n\nan authorized officer of the organization setting forth its new name\n\nor mailing address and pay a filing fee of Twenty-five Dollars\n\n($25.00). Such fee shall be deposited to the credit of the General\n\nRevenue Fund of the State Treasury.\n\nD. The professional fundraiser shall not employ or retain a\n\nprofessional solicitor who is not registered pursuant to this act.\n\nE. No professional fundraiser shall solicit any contribution\n\nfor a charitable organization without the consent of such\n\norganization.\n\nF. No person shall act as a professional fundraiser if the\n\nofficers, directors, or any person with a controlling interest in\n\nthe business, or any person the professional fundraiser employs or\n\nretains to solicit charitable contributions or to advise, consult,\n\nplan, or manage the solicitation of any contributions, has been\n\nconvicted by a court of any state or the United States of a felony\n\nor a misdemeanor involving moral turpitude or arising from his or\n\nher conduct in connection with fundraising activities, the\n\nsolicitation of any funds, or the use or expenditure of any funds\n\nraised, collected, or received in any fundraising activity.\n\nG.
