Every professional solicitor employed or retained by a\n\nprofessional fundraiser required to register pursuant to this act,\n\nshall, before engaging in any solicitation of contributions by the\n\nprofessional fundraiser, register with the Office of the Secretary\n\nof State. An application for registration, signed by the solicitor,\n\nshall state the full legal name and street address of the\n\nprofessional fundraiser that employs the solicitor and shall be\n\naccompanied by a fee in the amount of Twenty-five Dollars ($25.00)\n\nof which Ten Dollars ($10.00) shall be deposited to the credit of\n\nthe General Revenue Fund of the State Treasury. Ten Dollars\n\n($10.00) of the fee shall be deposited to the credit of the Attorney\n\nGeneral Charitable Solicitations Enforcement Revolving Fund and the\n\nremaining Five Dollars ($5.00) shall be deposited to the credit of\n\nthe Secretary of State Charitable Solicitations Revolving Fund.\n\nRegistration shall be for a period of one (1) year from the date of\n\nfiling with the Secretary of State, and may be renewed annually upon\n\nthe filing of a renewal application accompanied by a payment of the\n\nfee prescribed herein.\n\nB. When requesting a contribution, the professional solicitor\n\nshall clearly disclose or provide contact information for the\n\nfollowing information, if requested by the person being solicited:\n\n1. The name of the professional fundraiser that employs or\n\nretains the professional solicitor, as set out in the registration\n\nstatement filed with the Secretary of State, and the fact that the\n\nprofessional fundraiser is being paid for his or her services;\n\n2. The name of the charitable organization the person\n\nrepresents and a description of how the contributions raised by the\n\nsolicitation will be used; and\n\n3. The percentage of the contributions solicited that the\n\nprofessional fundraiser is to receive and the registration number of\n\nthe professional fundraiser, the charitable organization and the\n\nprofessional solicitor, as requested.\n\nC. No person shall act as a professional solicitor if the\n\nperson has been convicted by a court of any state or the United\n\nStates of a felony or of a misdemeanor involving moral turpitude or\n\narising from conduct by the person in connection with fundraising or\n\nthe solicitation of any funds, for or on behalf of a charitable\n\norganization, or the use or expenditure of any funds raised,\n\ncollected, or received in any fundraising activity.\n\nD.
