Any county creating a road improvement district pursuant to\n\nthe provisions of Sections 1230 through 1262 of this title, except\n\nas provided for in Section 1236 of this title, shall provide notice\n\nto the affected record title holders of private property and an\n\nopportunity to protest against said improvements. Any number of\n\nroads, streets, avenues, lanes, alleys, or other public places, or\n\nparts thereof, to be improved may be included in one notice. Any\n\nprotest or objection shall be made and considered separately as to\n\neach road, street, avenue, lane, alley, or other public place, or\n\nparts thereof. For purposes of protest in accordance with this\n\nsection, disconnected parts of the same street shall be treated as\n\nseparate streets.\n\nB. Upon the filing of said plans, plat, typical section, and\n\npreliminary estimate of the cost of such work or improvements with\n\nthe county clerk, the board of county commissioners shall examine\n\nthe same and, if found satisfactory, shall by resolution adopt and\n\napprove the same and declare the improvement necessary to be done.\n\nSaid resolution shall be published in six consecutive issues of a\n\ndaily newspaper or two consecutive issues of a weekly newspaper\n\npublished in the county and having a general circulation within the\n\ncounty. The resolution shall provide that the record title holders\n\nof more than forty percent (40%) of the area of land liable to\n\nassessment to pay for the improvement of any road, street, avenue,\n\nlane, alley, or other public place, or part thereof, choosing to\n\nprotest such road improvement shall file with the county clerk of\n\nsaid county their protest in writing against the improvement within\n\nfifteen (15) days after the last publication of the resolution. If\n\nsuch protest is not filed within the specified period, the county\n\nshall have the power to cause such improvements to be made and to\n\ncontract for such improvements and to levy assessments for the\n\npayment of such improvements. Any number of roads, streets,\n\navenues, lanes, alleys, or other public places, or parts thereof, to\n\nbe improved may be included in one resolution. After any road,\n\nstreet, avenue, lane, alley, or other public place, or part thereof,\n\nhas been protested by the record title holders of more than forty\n\npercent (40%) of the land liable to assessment for such improvement,\n\nthe board of county commissioners of said county shall not include\n\nthe same in proceedings pursuant to the provisions of Sections 1230\n\nthrough 1262 of this title for a period of six (6) months except\n\nupon petitions as provided by Section 1236 of this title.\n\nC. If sufficient protests are filed as to any one or more of\n\nsuch roads, streets, avenues, lanes, alleys, or other public places,\n\nor parts thereof, the same shall be eliminated from said\n\nproceedings, but the other roads, streets, avenues, lanes, alleys,\n\nor other public places, or parts thereof, as to which sufficient\n\nprotests have not been filed shall not be affected thereby. The\n\nprovisions of this subsection shall not apply to any development\n\npursuant to the provisions of Section 1236 of this title.\n\nD. Any person, firm, corporation, administrator, or guardian\n\nholding the title to said lands liable to assessment may enter a\n\nprotest or objection.\n\nE. The finding of the board as to the sufficiency or\n\ninsufficiency of the protest shall be conclusive and binding for all\n\npurposes and against all persons. The board shall have the power to\n\nhave hearings on said protest and compel the attendance of witnesses\n\nunder oath to determine the sufficiency of said protest. No action\n\nor suit to question the findings of the board on the sufficiency of\n\nsaid protests shall be commenced later than fifteen (15) days after\n\nsuch finding. Not less than ten (10) days before the hearing the\n\ncounty clerk shall notify each record title holder of lots or tracts\nngs on said protest and compel the attendance of witnesses\n\nunder oath to determine the sufficiency of said protest. No action\n\nor suit to question the findings of the board on the sufficiency of\n\nsaid protests shall be commenced later than fifteen (15) days after\n\nsuch finding. Not less than ten (10) days before the hearing the\n\ncounty clerk shall notify each record title holder of lots or tracts\n\nof land within said district as shown by the current ownership rolls\n\nprepared and certified by the county clerk within sixty (60) days\n\nlast preceding the date of the notification in the following manner:\n\n1. By mailing a postal card directly to said record title\n\nholder at his last-known address as shown by the ownership roll,\n\nnotifying said record title holder of the initiation of proceedings\n\nand advising him that his property will be liable to assessment and\n\nreferring him to the issues of the newspaper in which the resolution\n\nis or will be published. If titles to several tracts appear to be\n\nheld by the same person, all may be included in the same\n\nnotification; or\n\n2. In lieu of the mailing of a postal card, the county clerk\n\nmay mail to each record title holder a copy of the newspaper\n\npublication.\n\nProof of the notification given shall be made by certificate of the\n\nclerk which shall be filed in his office.
