Stat. tit. 19, § 19-1238","heading":"Resolution of contest or noncontest of improvement -","body":"Approval of plans and specifications - Contractor's bond - Bidding\n\nprocedure.\n\nAfter the expiration of the time for objection or protest on the\n\npart of the record title holders of property to an improvement, or\n\nif insufficient protest is filed, the board of county commissioners\n\nshall adopt a resolution declaring that no such protest has been\n\nfiled, or that such protest, if filed, was insufficient and\n\nexpressing the determination of the board to proceed with the\n\nimprovement. Such resolution shall require the engineer to\n\nimmediately file detailed plans, profiles, specifications, and\n\nestimates of probable cost. After the filing of said plans,\n\nprofiles, specifications, and estimates, the board shall examine the\n\nsame, and if found satisfactory, shall, by resolution, adopt and\n\napprove the same. The resolution shall state the material to be\n\nused and that the work or improvement will be constructed in\n\naccordance with the final detailed plans, specifications, and\n\nprofiles of the engineer. The resolution shall set forth any\n\nreasonable terms and conditions that the board of county\n\ncommissioners deems proper to impose. The board, by resolution,\n\nshall also provide that the contractor shall execute to the county a\n\ngood and sufficient bond in an amount to be stated in the\n\nresolution, conditioned for the full and faithful execution of the\n\nwork and the performance of the contract for the protection of the\n\ncounty and all record title holders of property interested, against\n\nany loss or damage by reason of the negligence of the contractor,\n\nimproper execution of the work or improvement, or the use of\n\ninferior material, and shall also require a bond, in an amount to be\n\nstated in said resolution, for the maintenance of said improvements\n\nagainst any failure due to defective workmanship or materials for a\n\nperiod of not less than one (1) year from the time of its completion\n\nand acceptance. Such maintenance bond shall not be required where\n\nsuch road improvements consist of oil and chips or graveling. The\n\nresolution shall also require the execution of a good and sufficient\n\nbond for payment of labor and material conditioned in accordance\n\nwith the laws of this state. The resolution shall also direct the\n\ncounty clerk after the filing of said final plans, profiles,\n\nspecifications, and estimates to advertise for sealed bids for\n\nfurnishing the materials and performing the work necessary in making\n\nthe improvement. The notice for such bids shall state the roads,\n\nstreets, avenues, or public places to be improved, the kind of\n\nimprovements proposed, what bonds will be required to be executed by\n\nthe contractor, shall refer to the plans and specifications, and\n\nshall state the date, time, and place where such sealed bids shall\n\nbe filed, and the date and place the same will be considered by the\n\nboard. The notice shall state the manner of payment to the\n\ncontractor and whether the contractor will be paid in money, in\n\nbonds or in a proportion of money and bonds for making the\n\nimprovement. The notice shall be published in accordance with the\n\nprovisions of the Public Competitive Bidding Act of 1974. No action\n\nor suit to question the adoption of said resolution, or the\n\nsufficiency of the same or the final, detailed estimate of the\n\nengineer, shall be commenced later than fifteen (15) days after the\n\nfirst publication of said notice.\n\nThe resolution provided for in this section shall be adopted not\n\nlater than six (6) months after the adoption of the resolution of\n\nnecessity provided for in Section 1234 of this title or within six\n\n(6) months after the filing of a proper petition for the\n\nconstruction of the contemplated improvements.","path":["OK Code","Title 19"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os19.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f465bc7eca0d72bc3caeeb50f6edf683edcb3204fc19bbbeb280a5f9a593198e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-19-19-1237","next":"us-ok/okla.-stat.-tit.-19-19-1239"},"notice":"GroundRules: Original legal text.
