Stat. tit. 19, § 19-1250","heading":"Installments - Payment - Collecting agent - Duties","body":"The assessments provided for and levied pursuant to the\n\nprovisions of Sections 1230 through 1262 of this title shall be\n\npayable as the installments become due, together with the interest\n\non said installments, to the county clerk who shall give proper\n\nreceipts for such payments and credit the same upon the road\n\nassessment record. It shall be the duty of the county clerk to keep\n\nan accurate account of all such collections made by the clerk and to\n\npay to the county treasurer daily the amounts of such assessments\n\ncollected by the clerk. The amounts so collected and paid to the\n\ncounty treasurer shall constitute a separate, special fund to be\n\nused and applied to the payment of such bonds and the interest\n\nthereon, as provided by Sections 1257 through 1260 of this title.\n\nIt shall be the duty of the county clerk, not less than thirty (30)\n\ndays and not more than forty (40) days before the maturity of any\n\ninstallment of such assessments, to publish in two successive issues\n\nof a daily newspaper or in one issue of a weekly newspaper,\n\npublished in the county and of general circulation in said county, a\n\nnotice advising the record title holder of the land affected by such\n\nassessment of the date when such installment and interest will be\n\ndue, and designating the road, street, streets, or public places, or\n\nparts thereof, for the improvement of which such assessments have\n\nbeen levied, and that unless such assessments shall be promptly\n\npaid, said installment and interest shall bear interest at the rate\n\nof fifteen percent (15%) per annum until paid, and proceedings taken\n\naccording to law to collect said installment and interest. It shall\n\nalso be the duty of the county clerk, not less than thirty (30) days\n\nbefore the maturity of any installment of such assessments, to send\n\na notice by mail advising the record titleholder of the land\n\naffected by such assessment of the date when such installment and\n\ninterest will be due, and designating the road, street, streets, or\n\npublic places, or parts thereof, for the improvement of which such\n\nassessments have been levied, and that unless such assessments shall\n\nbe promptly paid, said installment and interest shall bear interest\n\nat the rate of fifteen percent (15%) per annum until paid, and\n\nproceedings taken according to law to collect said installment and\n\ninterest. Failure of the owner to receive any notice shall not\n\ninvalidate any of the proceedings authorized in this title and shall\n\nnot invalidate any installment or interest that may be due. It\n\nshall be the duty of the county clerk, promptly after the date of\n\nmaturity of any such installment and interest and on or before the\n\nfifteenth day of September in each year, to certify such installment\n\nand interest due to the county treasurer of the county in which the\n\nimprovement district is located, which installment and interest\n\nshall be placed by said county treasurer upon the November\n\ndelinquent tax list of the same year prepared by the treasurer of\n\nsaid county and collected as other delinquent taxes are collected.\n\nIt shall be the duty of the county treasurer to collect such\n\ninstallments of assessment, together with interest and penalty, so\n\ncertified to the treasurer by the county clerk, as provided for in\n\nthis section, but any taxpayer shall have the right to pay his ad\n\nvalorem taxes to the county treasurer regardless of the delinquency\n\nof such assessments. Within thirty (30) days from the receipt of\n\nsuch delinquent assessments, interest and penalty collected by the\n\ncounty treasurer shall be disbursed in accordance with the\n\nprovisions of Sections 1230 through 1262 of this title. Failure of\n\nthe county clerk to publish notice of the maturing of any\n\ninstallment and interest shall in no way affect the validity of the\n\nproceedings to collect such installment and interest pursuant to the\nipt of\n\nsuch delinquent assessments, interest and penalty collected by the\n\ncounty treasurer shall be disbursed in accordance with the\n\nprovisions of Sections 1230 through 1262 of this title. Failure of\n\nthe county clerk to publish notice of the maturing of any\n\ninstallment and interest shall in no way affect the validity of the\n\nproceedings to collect such installment and interest pursuant to the\n\nprovisions of this section.
