Stat. tit. 19, § 19-1251","heading":"Action to foreclose lien - Petition - Summons - Parties -","body":"Judgments - Surety bond or deposit.\n\nAny holder of any road improvement bond issued pursuant to the\n\nprovisions of Sections 1230 through 1262 of this title shall have\n\nthe right to institute, in the name of the county issuing such bond,\n\nan action in the district court of the county in which said property\n\nis located to foreclose the lien of such assessment whenever such\n\nassessment, or any installment thereof, is delinquent for a period\n\nof at least twelve (12) months. The petition shall state generally\n\nthe ownership of such bond, describing the property assessed, the\n\nnature of the improvement, the amount of the unpaid delinquent\n\nassessment and penalty thereon at the rate of fifteen percent (15%)\n\nper annum, and praying for the foreclosure of such lien. Summons\n\nshall be issued on such petition as in other civil actions and the\n\ncause tried in the district court. Judgment may be entered on such\n\npetition for the amount of such unpaid assessment or installment\n\ntogether with interest thereon at the rate of fifteen percent (15%)\n\nper annum from the date such assessment or installment was due and\n\npayable up to the time of the institution of such action and for the\n\nsum of fifteen percent (15%) interest on said judgment from the time\n\nof the institution of such action until said judgment is paid. In\n\nthe event said judgment, together with interest and costs, is not\n\npaid within six (6) months after the date the judgment was rendered,\n\nan order of sale shall be issued by the clerk of said court\n\ndirecting the sheriff of the county to sell said real estate in\n\nmanner and form as in the case of sale of real estate under\n\nexecution. The judgment shall carry the costs of such action\n\ntogether with the costs of such sale. Upon the payment of such\n\njudgment, the amount of the payment, exclusive of costs, shall be\n\npaid to the county treasurer and become a part of the fund to pay\n\nsuch outstanding bonds and interest. The judgment shall provide for\n\nthe sale of the real estate subject to existing general or ad\n\nvalorem taxes and special assessments. All record title holders or\n\nencumbrancers shall be made parties defendant in such suit. Upon\n\nthe institution of an action to collect delinquent and unpaid\n\nassessments in any improvement district within one (1) year of the\n\ncompletion of any improvement, county commissioners of any county\n\nshall require the contractor performing such work or improvement to\n\nmake and execute a good and sufficient surety bond or deposit\n\nsufficient securities or obligations of the United States of\n\nAmerica, of this state, or some municipality subdivision thereof, to\n\nbe approved by said board of county commissioners in the sum to be\n\ndetermined by the board of county commissioners, in no case to be\n\nless than ten percent (10%) of the contract price, conditioned that\n\nthe contractor will immediately reimburse the county for the\n\nmaintenance of said improvements against any failure due to\n\ndefective workmanship or materials for a period of one (1) year from\n\nthe time of its completion and acceptances.","path":["OK Code","Title 19"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os19.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"0a91f13ed56f0b2a6e0f4ead32a30a44bd48e4b678e044d50c8d67d08c806c35","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-19-19-1250","next":"us-ok/okla.-stat.-tit.-19-19-1252"},"notice":"GroundRules: Original legal text.
