Stat. tit. 19, § 19-137.2","heading":"Appointment - Salary - Assistants","body":"The position of public defender shall be filled by appointment\n\nof the board of county commissioners with an attorney authorized to\n\npractice law in this state and who has been recommended by the\n\ndistrict attorney and the judges of the courts of record of such\n\ncounty. The public defender and operating expenses of such office\n\nshall be paid from the funds in the county general revenue fund an\n\namount to be determined by the board of county commissioners which\n\namount shall not be in excess of ninety percent (90%) of the salary\n\nof the district attorney of such county that is paid from the\n\ngeneral revenue fund of the county.
