Stat. tit. 19, § 19-138.9","heading":"Counties of 200,000 or more","body":"In those counties with a population in excess of three hundred\n\nthousand (300,000) under the latest Federal Decennial Census, the\n\ncounty indigent defenders, for those counties subject to the\n\nprovisions of Section 138.1a of this title, shall perfect appeals\n\nfor those defendants which they represented in the trial court\n\nunless an appellate conflict exists between two or more such\n\ndefendants, in which case the county indigent defender shall\n\nrepresent one defendant, the Oklahoma Indigent Defense System shall\n\nrepresent one defendant, and the court may assign the appeal of the\n\ncase for any other defendants in the same manner as provided for\n\nconflict at the trial level in Section 138.7 of this title. If an\n\nappellate conflict of interest exists between the defendant and the\n\ncounty indigent defender in a case in which the defendant has\n\nreceived the death penalty, the district court may appoint the\n\nIndigent Defense System to represent the defendant on appeal. The\n\nOklahoma Indigent Defense System shall also represent all indigent\n\ndefendants from such counties who were not represented at trial by\n\nthe county public defenders unless a conflict of interest on appeal\n\nexists between defendants, in which case the Oklahoma Indigent\n\nDefense System shall represent one defendant, the county indigent\n\ndefender shall represent one defendant and the court may assign the\n\nappeal of the case for any other defendants in the same manner as\n\nprovided for conflict at the trial level in Section 138.7 of this\n\ntitle.","path":["OK Code","Title 19"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os19.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f5636ce7991663257f2bf26a857f921c4610d80d60cabea8996aa2ae7296730c","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-19-19-138.8","next":"us-ok/okla.-stat.-tit.-19-19-14"},"notice":"GroundRules: Original legal text.
