Except as otherwise provided by Section 1500 et seq. of this\n\ntitle, the county purchasing agent shall have the authority to\n\ndevelop, implement, and promote policies and procedures that allow\n\nthe procurement of materials and equipment through contracts that\n\nare flexible, value based and are in the best interests of the state\n\nand its political subdivisions.\n\nB. Except as otherwise provided, the county purchasing agent\n\nshall have the authority to use electronic commerce for the\n\nsolicitation, notification, and other purchasing processes. For\n\npurposes of this subsection, “electronic commerce” means the use of\n\nelectronic methods to enable solicitations, open bids, supplier\n\nresponse, bid submission, notice of contract award, county\n\nacquisition processes, or any other function to make an acquisition.\n\nC. The boards of county commissioners shall have the authority\n\nto conduct a procurement transaction by electronic means subject to\n\nthe provisions of the Uniform Electronic Transactions Act.\n\nD. The board of county commissioners shall have the authority\n\nto establish an online bidding process with a vendor.\n\n1. The purchasing agent shall comply with all bid notice\n\nrequirements as prescribed in paragraph 2 of subsection B of Section\n\n1505 of this title or the Public Competitive Bidding Act of 1974.\n\n2. Solicitations shall designate an opening and closing date\n\nand time for bids. Sealed bids received pursuant to this subsection\n\nshall be first opened in an open meeting of the board of county\n\ncommissioners concurrently with other sealed bids received as\n\nprovided in Section 1505 of this title or the Public Competitive\n\nBidding Act of 1974.\n\n3. The board of county commissioners shall be authorized to\n\nrequire online bidders to register before the opening date and time\n\nand, as part of that registration, require bidders to agree to any\n\nterms, conditions, or other requirements of the solicitation or\n\napplicable acts.\n\n4. The board of county commissioners shall be authorized to\n\nrequire potential online bidders to prequalify as bidders.\n\nSolicitations and published bid notices shall indicate the\n\nprequalification requirements for online bids.
