Stat. tit. 19, § 19-1501","heading":"Duties of county purchasing agent - Requisition of","body":"purchase orders.\n\nA. The county purchasing agent:\n\n1. Shall, within the amount of the unencumbered balance, make\n\nall purchases that are paid from county funds for the various\n\ninstitutions, departments, officers, and employees of the county,\n\nexcept at public auctions and as otherwise provided for by law;\n\n2. May make purchases for political subdivisions of this state\n\nwithin the county if authorized by appropriate action of the\n\ngoverning board or body of the political subdivision affected;\n\n3. Shall make purchases and rental or lease-purchase agreements\n\nonly after following the bidding procedures as provided for by law,\n\nexcept:\n\na. when the purchase does not exceed Twenty-five Thousand\n\nDollars ($25,000.00) by department. All purchases\n\nmade pursuant to this subparagraph shall be by a\n\nsingle purchase order. Splitting purchase orders\n\nwhich would result in paying an amount in excess of\n\nthe limitations specified in this subparagraph is\n\nexpressly prohibited. Any person convicted of\n\nviolating the provisions of this subparagraph shall be\n\nguilty of a misdemeanor and such person shall forfeit\n\nthe person’s position or office,\n\nb. when the total payments of a rental or lease-purchase\n\nagreement do not exceed the current bid limit as\n\nestablished in subparagraph a of this paragraph,\n\nc. when articles and items are covered by single-source\n\ncontracts,\n\nd. service or maintenance contracts on equipment or\n\nmachinery which are entered into at the time of the\n\npurchase of the equipment or machinery,\n\ne. purchases made pursuant to a blanket purchase order as\n\nprovided for in Section 310.8 of Title 62 of the\n\nOklahoma Statutes,\n\nf. when materials for road or bridge improvements do not\n\nexceed Seven Dollars ($7.00) per yard or per ton,\n\ng. purchases of fuel if the county purchasing agent\n\nobtains quotes from at least three vendors prior to\n\nthe purchase and the lowest and best quote is\n\nselected. Documentation of these quotes shall be\n\nrecorded in the permanent records of the clerk,\n\nh. purchases of tools, apparatus, machinery, or equipment\n\nfrom a state agency or a political subdivision of the\n\nstate as provided for in subsection C of Section 421.1\n\nof this title,\n\ni. purchases of food for prisoners incarcerated in the\n\ncounty jail; provided, in counties having a population\n\nin excess of one hundred thousand (100,000) persons,\n\nthe county purchasing agent shall follow bidding\n\nprocedures as provided by law unless the county\n\npurchasing agent obtains quotes pursuant to the whole\n\ntotal of food items requisitioned prior to the\n\npurchase and the lowest and best quote is selected.\n\nDocumentation of these quotes shall be recorded in the\n\npermanent records of the county clerk,\n\nj. when a county solicits bids for the purchase of\n\nprocessed native materials for road and bridge\n\nimprovements, the county may accept all bids received,\n\nwith the lowest and best bid from those accepted to be\n\nselected at the time of opening of any construction\n\nproject. The selection of the bid shall be based upon\n\navailability, bid price, and transportation costs,\n\nk. when a vendor has been selected as the lowest and best\n\nbidder to furnish a particular item or items to the\n\ncounty during a specified time period and in the event\n\nthe vendor is unable to perform, the purchasing agent\n\nmay solicit telephone quotes for the item or items\n\nneeded or select the next lowest and best bidder from\n\nthe list of qualified bidders and provide for the\n\npurchase of the items at the lowest and best quote\n\navailable. All vendors submitting bids for the\n\nspecific product or service will be considered at or\n\nbelow the amount they bid,\n\nl. when considering the purchase of an item or items from\n\nthe state bid list as provided by the Office of\n\nManagement and Enterprise Services or the General\n\nServices Administration, if the same exact item is\n\navailable from a local vendor at or below the price\nquote\n\navailable. All vendors submitting bids for the\n\nspecific product or service will be considered at or\n\nbelow the amount they bid,\n\nl. when considering the purchase of an item or items from\n\nthe state bid list as provided by the Office of\n\nManagement and Enterprise Services or the General\n\nServices Administration, if the same exact item is\n\navailable from a local vendor at or below the price\n\nlisted on the state bid list or the General Services\n\nAdministration list, the item may be obtained from the\n\nvendor,\n\nm. any item or items bid by the Office of Management and\n\nEnterprise Services which may be purchased by the\n\ncounty, provided the vendor is willing to supply the\n\nitem or items to the county at the bid price,\n\nn. when a county obtains proceeds from the sale of its\n\nproperty at a public auction, that county may use\n\nthose proceeds to acquire items previously identified\n\nas needed by the county at the same public auction\n\npursuant to subsection D of Section 1505 of this\n\ntitle,\n\no. when an item or items have been competitively bid by a\n\ncounty, or on behalf of a group of counties, provided:\n\n(1) the notice to bidders shall list each county\n\nwhich may participate in the purchase of the item\n\nor items being bid,\n\n(2) the notice of bid is advertised, as provided by\n\nlaw, in each of the counties which may\n\nparticipate in the purchase of the item or items,\n\n(3) all vendors on the list of qualified bidders of\n\neach participating county who offer the item or\n\nitems for sale received notice of the bid\n\nrequest, and\n\n(4) the vendor awarded the bid is willing and able to\n\nprovide the item or items at the bid price,\n\np. counties may participate in a nationwide purchasing\n\nprogram sponsored by the national association\n\nrepresenting counties and local cooperative\n\nprocurement agreements entered into by the counties\n\nand other local jurisdictions or any other\n\ncompetitively bid nationwide purchasing program, or\n\nq. when the Governor declares an emergency in a county,\n\nthe district attorney of that county shall have the\n\nauthority to temporarily waive competitive bidding\n\nprocedures for purchases that may expedite a response\n\nto the emergency situation. This temporary waiver\n\nshall be in addition to any powers exercised pursuant\n\nto Section 683.11 of Title 63 of the Oklahoma\n\nStatutes.\n\nThe purchases shall be paid by attaching properly itemized\n\ninvoices, as described in Section 1505 of this title, to a purchase\n\norder which has been prepared by the county purchasing agent and\n\nsubmitting both to the county clerk for filing, encumbering, and\n\nconsideration for payment by the board of county commissioners;\n\n4. Shall not furnish any supplies, materials, equipment, or\n\nother articles, except upon receipt of a requisition signed by a\n\ncounty officer. Written requisitions will not be required for\n\nblanket purchase orders as provided for in Section 310.8 of Title 62\n\nof the Oklahoma Statutes. Each county officer may designate not\n\nmore than two employees who also shall be authorized to sign\n\nrequisitions in the absence of the county officer. A written\n\ndesignation of the employees shall be filed with the county clerk\n\nand shall be entered in the minutes of the board of county\n\ncommissioners. The county may designate two individuals who are not\n\ncounty employees for each of the following entities within the\n\ncounty to act as receiving and requisitioning officers:\n\na. fire protection districts organized and operated\n\npursuant to the provisions of Sections 901.1 through\n\n901.29 of this title,\n\nb. fire protection services established pursuant to the\n\nprovisions of Section 351 of this title,\n\nc. volunteer or full-time fire departments established\n\npursuant to Section 592 of Title 18 of the Oklahoma\n\nStatutes, and\n\nd. municipal fire departments organized and operated\nre protection districts organized and operated\n\npursuant to the provisions of Sections 901.1 through\n\n901.29 of this title,\n\nb. fire protection services established pursuant to the\n\nprovisions of Section 351 of this title,\n\nc. volunteer or full-time fire departments established\n\npursuant to Section 592 of Title 18 of the Oklahoma\n\nStatutes, and\n\nd. municipal fire departments organized and operated\n\npursuant to the provisions of Sections 29-101 through\n\n29-115 of Title 11 of the Oklahoma Statutes.\n\nA written designation of these individuals shall be filed with\n\nthe county clerk and shall be entered in the minutes of the board of\n\ncounty commissioners meeting in which the designations are made.\n\nFurther, entities described in subparagraphs a, b, c, and d of this\n\nparagraph, choosing to have any nonemployee of the county designated\n\nas a receiving and requisitioning officer shall provide evidence of\n\nblanket bond coverage or employee dishonesty liability insurance for\n\neach such designee;\n\n5. Shall make lease or lease-purchase agreements for road\n\nmachinery and equipment if the county has adequate funds\n\nappropriated during any fiscal year for such purpose and only after\n\nfollowing the bidding procedures as provided for in Section 1505 of\n\nthis title. The term of any lease or lease-purchase agreement\n\nauthorized pursuant to this paragraph may be for any period up to\n\none (1) year; provided, the term shall not extend beyond the end of\n\nany fiscal year, with an option to renew such agreement subject to\n\nthe requirement that adequate funds are appropriated during the\n\nfiscal year by the county for such purpose. The Office of the State\n\nAuditor and Inspector shall be notified by the county of the terms\n\nand conditions of a lease or lease-purchase agreement authorized\n\npursuant to this paragraph before any such agreement is made by the\n\ncounty purchasing agent; and\n\n6. Shall perform such other duties as may be delegated by the\n\nappointing authority or as may be provided for by law.\n\nB. Each department of county government needing repairs to\n\nequipment, machinery, or vehicles shall make estimates and\n\nrequisition a purchase order from the county purchasing agent for\n\nrepairs not in excess of Ten Thousand Dollars ($10,000.00). Repairs\n\nin excess of Ten Thousand Dollars ($10,000.00) shall be submitted on\n\na blanket purchase order as provided in Section 310.8 of Title 62 of\n\nthe Oklahoma Statutes.\n\nC. Each department of county government needing repairs to\n\nheavy equipment, meaning equipment in excess of ten thousand\n\n(10,000) pounds, shall make estimates and requisition a purchase\n\norder from the county purchasing agent for repairs not in excess of\n\nThirty Thousand Dollars ($30,000.00). Repairs in excess of Thirty\n\nThousand Dollars ($30,000.00) shall be submitted on a blanket\n\npurchase order as provided in Section 310.8 of Title 62 of the\n\nOklahoma Statutes.","path":["OK Code","Title 19"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os19.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"31c57588eef242fdbae2746442c03ddd261defa819a81bed0394b0721c0d6a4e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-19-19-1500.1","next":"us-ok/okla.-stat.-tit.-19-19-1502"},"notice":"GroundRules: Original legal text.
