The provisions of the Transient Merchant Licensing Act shall\n\nnot apply to:\n\n1. Sales at wholesale to retail merchants by commercial\n\ntravelers or selling agents in the usual course of business;\n\n2. Wholesale trade shows or conventions;\n\n3. Sales of goods, wares, or merchandise by sample, catalog or\n\nbrochure for future delivery;\n\n4. Fairs and convention center activities conducted primarily\n\nfor amusement or entertainment;\n\n5. Any general sale, fair, auction, or bazaar sponsored by any\n\nchurch or religious organization;\n\n6. Any sale sponsored by schools and universities or any\n\ncharitable organization;\n\n7. Trade fairs;\n\n8. Flea markets;\n\n9. Garage sales held on the premises devoted to residential\n\nuse;\n\n10. Sales of crafts or items made by hand and sold or offered\n\nfor sale by the person making such crafts or handmade items;\n\n11. Sales of agricultural products, including Christmas trees\n\nand firewood;\n\n12. Sales made by a seller at residential premises pursuant to\n\nan invitation issued by the owner or legal occupant of such\n\npremises;\n\n13. Any person who maintains a permanent place of business in\n\nthis state and has a registered agent therein upon whom process,\n\nnotice, or demand permitted by law may be made;\n\n14. Any person whose participation with a \"transient merchant\"\n\nor in the \"temporary or transient business\" is limited to providing\n\nany building, structure, motor vehicle, railroad car or real estate;\n\n15. Fireworks; or\n\n16. Bibles.\n\nB. A transient merchant not otherwise exempted from the\n\nprovisions of the Transient Merchant Licensing Act shall not be\n\nrelieved or exempted from the provisions of the Transient Merchant\n\nLicensing Act by reason of associating himself temporarily with any\n\nlocal dealer, auctioneer, trader, contractor, or merchant or by\n\nconducting such temporary or transient business in connection with\n\nor in the name of any local dealer, auctioneer, trader, contractor,\n\nor merchant.","path":["OK Code","Title 19"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os19.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"751d779b570758c57f61db04fd154bec0d9f8c423563f50ba1c8b648ca264354","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-19-19-1602","next":"us-ok/okla.-stat.-tit.-19-19-1604"},"notice":"GroundRules: Original legal text.
