The officers named in paragraph 1 of Section 180.61 of this\n\ntitle shall have such number of regular or technical deputies,\n\nassistants, investigators, evidence persons, aides, stenographers or\n\nreporters, technicians, undersheriffs, jailers, matrons, handwriting\n\nand fingerprint experts, probation officers, juvenile officers,\n\nbailiffs or other help, whatever title the principal officer may\n\nascribe to the duties or functions to be performed as authorized by\n\nlaw and clearly related to the proper accomplishment of lawful\n\nfunctions, whether on whole or part-time basis, at such rates of\n\nsalary or pay, subject to the provisions of this section as\n\nhereinafter set forth, as the principal officer may propose and\n\nestablish the need of and which the county excise board may approve,\n\nfor the adequate accomplishment of the functions of the office and\n\nthe performance of the duties imposed thereon by law, with due\n\nweight being given to employment on whole or part-time basis.\n\nHowever, no such employments shall exceed the amount of lawful funds\n\nappropriated for such purpose, provided however, nothing in this\n\nsection shall be interpreted to prohibit additional salary payments\n\nor stipends paid from the Sheriff's Service Fee Account.\n\nB. Each principal officer named in paragraph 1 of Section\n\n180.61 of this title, except judges, shall designate of record in\n\nthe office of the county clerk a first or chief deputy, undersheriff\n\nor assistant who shall be chargeable with all the duties of such\n\nprincipal officer, while subject to the direction of the same. The\n\nfirst or chief deputy, undersheriff or assistant shall carry on the\n\nduties of the office during the absence of the principal officer or,\n\nin the event of the death, removal or resignation of said principal\n\nofficer, until a successor shall have qualified. During periods of\n\nvacancy of the principal office, resulting from the death, removal\n\nor resignation of the principal officer, the chief deputy,\n\nundersheriff or assistant shall be bonded in the same manner and in\n\nthe same sum as required for the principal officer.\n\nC. No deputy, as defined in paragraph 2 of Section 161 of this\n\ntitle, shall receive a salary in excess of the principal officer.\n\nAny employee employed to perform duties that are not in assistance\n\nto a county officer in the performance of the official duties of the\n\ncounty officer including, but not limited to, specialized or\n\ntechnical duties, may receive a salary in excess of a county\n\nofficer. The salaries set forth in this subsection within the\n\nlimitations shall be such amounts as the principal officer may\n\npropose and establish the need for and which the county excise board\n\nmay approve within salary and staffing requirements as may be\n\nprescribed by law. The numerical rank of any deputy or assistant to\n\nbe effective must be by designation of the principal officer by the\n\nsignature of the principal officer and filed with the county clerk.\n\nThe numerical rank of any deputy or assistant shall be within the\n\nsole discretion of the principal officer.\n\nD. The board of county commissioners shall continue to have the\n\nauthority to recommend the total amount of funds that can be used\n\nfor the combined salaries in each of the county offices covered by\n\nthis title. However, the approval of the funding for such offices\n\nshall continue to be the responsibility of the county excise board.\n\nCounty officers shall have no authority to make salary commitments\n\nbeyond the amount of the funding so provided.\n\nE. The county excise board shall meet with each of the\n\nprincipal officers of the county in budget planning conference or\n\nconferences, before July 1 of each year, to discuss personnel needs\n\nfor each office for the succeeding fiscal year. The excise board\n\nshall provide the principal officers a tentative estimate of\n\nanticipated revenues for the next fiscal year prior to the budget\nso provided.\n\nE. The county excise board shall meet with each of the\n\nprincipal officers of the county in budget planning conference or\n\nconferences, before July 1 of each year, to discuss personnel needs\n\nfor each office for the succeeding fiscal year.
