A county of the state is authorized to use a reverse auction\n\nbidding procedure to obtain bids for the purchase of goods or\n\nservices of any type or kind. The reverse auction shall be a real-\n\ntime bidding process taking place at a previously scheduled time and\n\nInternet location and for a previously established duration, in\n\nwhich multiple suppliers, anonymous to each other, submit bids to\n\nprovide the goods or services. The reverse auction procedure may be\n\nused as an alternative to any state law applicable to the purchase\n\nof the goods or services.\n\nB. The procedure shall provide:\n\n1. A bid opening and bid closure. At the opening date and\n\ntime, the county shall begin accepting reverse auction electronic\n\nbids. Reverse auction bids shall be accepted until the bid closure,\n\nexcept as provided by paragraph 6 of this subsection, unless the\n\ncounty determines it is in the best interest of the county to extend\n\nthe closing time and notifies the reverse auction bidders of the\n\nextended closing time by public announcement at the Internet\n\nlocation at least fifteen (15) minutes prior to the original closing\n\ntime;\n\n2. The posting of all reverse auction bids electronically and\n\nupdating of bids on a real-time basis by the county;\n\n3. The authorization for the county to require bidders to\n\nregister before the opening date and time and, as part of that\n\nregistration, require bidders to agree to any terms, conditions or\n\nother requirements of the solicitation or applicable acts;\n\n4. The authorization for the county to also require potential\n\nbidders to prequalify as bidders and to restrict solicitations to\n\nprequalified online and reverse auction bidders;\n\n5. The retention of the authority of the county to determine\n\nthe criteria that will be used as the basis for making awards; and\n\n6. The authorization for the county to determine it is in the\n\nbest interest of the county to allow it to accept an electronic bid\n\nafter the specified official closing date and time, in the event the\n\ncounty determines that a significant error or event occurred that\n\naffected the electronic receipt of any reverse auction bid by the\n\ncounty.\n\nC. All bids submitted electronically through the reverse\n\nauction bidding process pursuant to this section are subject to the\n\nsame public disclosure laws that govern bids received pursuant to\n\nany other law of this state governing procurement procedures for a\n\ncounty.\n\nD.
