There is hereby created the District Attorneys Council which\n\nshall be organized and administered as herein provided. Any\n\nreference in the Oklahoma Statutes to the District Attorneys\n\nTraining Coordination Council shall mean the District Attorneys\n\nCouncil.\n\nB. The chief executive officer of the office of the Council is\n\nthe Executive Coordinator who shall be appointed and supervised by\n\nthe Council. The Executive Coordinator shall serve at the pleasure\n\nof the Council. The Executive Coordinator shall be licensed to\n\npractice law in Oklahoma and shall have been a district attorney or\n\nassistant district attorney or have held an equivalent position in\n\nstate or federal government for at least three (3) years prior to\n\nappointment. The Executive Coordinator may appoint an Assistant\n\nCoordinator, both of whom shall be in the unclassified service of\n\nthe state. The Executive Coordinator and the Assistant Coordinator,\n\nwho shall also be licensed to practice law in Oklahoma, shall devote\n\nfull time to their duties and shall not engage in the private\n\npractice of law. The Executive Coordinator shall perform the\n\nfunctions and duties as may be assigned by the Council. The\n\nExecutive Coordinator shall be named the project director and fiscal\n\nofficer of any grant or fund received by the Council. The Executive\n\nCoordinator and the Assistant Coordinator shall receive compensation\n\nfor their services within the pay scale limits for district\n\nattorneys.\n\nC. 1. The Council shall be composed of the following members:\n\na. the Attorney General, or a designated representative\n\nof the Attorney General,\n\nb. the President of the Oklahoma District Attorneys\n\nAssociation,\n\nc. the President-elect of the Oklahoma District Attorneys\n\nAssociation,\n\nd. one district attorney selected by the Court of\n\nCriminal Appeals for a three-year term, and\n\ne. one district attorney selected by the Board of\n\nGovernors of the Oklahoma Bar Association for a three-\n\nyear term.\n\n2. A member of the Council shall vacate the appointment upon\n\ntermination of the member's official position as Attorney General or\n\ndistrict attorney. A vacancy shall be filled in the same manner as\n\nthe original appointment. A member appointed to fill a vacancy\n\ncreated other than by expiration of a term shall be appointed for\n\nthe unexpired term of the member whom the appointed member is to\n\nsucceed in the same manner as the original appointment. Any member\n\nmay serve more than one term.\n\nD. The Council shall designate from among its members a\n\nChairman and Vice Chairman who shall serve for one-year terms and\n\nwho may be reelected. Membership on the Council shall not\n\nconstitute holding a public office. The Council shall not have the\n\nright to exercise any portion of the sovereign power of the state.\n\nA member of the Council shall not be disqualified from holding any\n\npublic office or employment by reason of appointment or membership\n\non the Council, nor shall the member forfeit the office or\n\nemployment, by reason of appointment to the Council.\n\nE. The Council shall meet at least four times in each year and\n\nshall hold special meetings when called by the Chairman, or, in the\n\nabsence of the Chairman, by the Vice Chairman or when called by the\n\nChairman upon the written request of two members of the Council.\n\nThe Council shall establish its own procedures and requirements with\n\nrespect to quorum, place and conduct of its meetings and other\n\nmatters.\n\nF. The members of the Council shall not receive a salary for\n\nduties performed as members of the Council but shall be entitled to\n\nbe reimbursed for their travel expenses in accordance with the State\n\nTravel Reimbursement Act.\n\nG. The Council shall make an annual report to the Governor, the\n\nPresident Pro Tempore of the Senate, the Speaker of the House of\n\nRepresentatives, and the President of the Oklahoma District\n\nAttorneys Association regarding its efforts to implement the\ns members of the Council but shall be entitled to\n\nbe reimbursed for their travel expenses in accordance with the State\n\nTravel Reimbursement Act.\n\nG. The Council shall make an annual report to the Governor, the\n\nPresident Pro Tempore of the Senate, the Speaker of the House of\n\nRepresentatives, and the President of the Oklahoma District\n\nAttorneys Association regarding its efforts to implement the\n\npurposes of this section.\n\nH. The Council shall have the power to perform such functions\n\nas in its opinion shall strengthen the criminal justice system in\n\nOklahoma, to provide a professional organization for the education,\n\ntraining and coordination of technical efforts of all state\n\nprosecutors and to maintain and improve prosecutor efficiency and\n\neffectiveness in enforcing the laws of this state including, but not\n\nlimited to, the following:\n\n1. Organize, supervise and perform functions consistent with\n\nthis section;\n\n2. Convene regional or statewide conferences and training\n\nseminars for the purpose of implementing the provisions of this\n\nsection;\n\n3. Accept and expend monies, gifts, grants or services from any\n\npublic or private source; contract or enter into agreements with\n\neducational institutions or state or federal agencies; and employ\n\npersonnel as the Council in its judgment finds necessary to\n\neffectively carry out the provisions of this section. Such\n\nemployees shall be in the unclassified service of the state;\n\n4. Serve in an advisory capacity to the district attorneys of\n\nthe state;\n\n5. Provide and coordinate training and continuing legal\n\neducation for district attorneys and their assistants, including\n\nparticipation in nationally recognized prosecutorial seminars\n\nconducted in other states. Subject to available funding, curriculum\n\nfor training required under this paragraph shall include, but not be\n\nlimited to:\n\na. dynamics of domestic violence,\n\nb. the impact of domestic violence on victims and their\n\nchildren including victim trauma and the neurobiology\n\nof trauma,\n\nc. identifying dominant aggressor,\n\nd. tactics and behavior of batterers,\n\ne. victim protection orders and full faith and credit\n\nunder the Violence Against Women Act of 1994,\n\nf. rights of victims, and\n\ng. evidence-based practices regarding behavioral health\n\nand treatment of those with substance abuse or mental\n\nhealth needs;\n\n6. Gather and disseminate information to district attorneys\n\nrelative to their official duties, including changes in the law\n\nrelative to their office;\n\n7. Coordinate with law enforcement officers, the courts and\n\ncorrections workers providing interdisciplinary seminars to augment\n\nthe effectiveness of the criminal justice system;\n\n8. Require statistical reports from district attorneys' offices\n\nrelating to functions and workload performance;\n\n9. Recommend additional legislation necessary to upgrade the\n\nOklahoma District Attorneys System to professional status;\n\n10. Establish an equitable distribution plan for allocation of\n\nany funds or gifts received from public or private sources for state\n\nprosecution and distribute such funds in accordance with such plan;\n\nand\n\n11. Appoint a larger Advisory Council made up of district\n\nattorneys and assistant district attorneys to discuss problems and\n\nhear recommendations concerning necessary research, minimum\n\nstandards, educational needs, and other matters imperative to\n\nupgrading Oklahoma prosecution to professional status.\n\nI. There is hereby created in the State Treasury a revolving\n\nfund for the Council, to be designated the \"District Attorneys\n\nCouncil Revolving Fund\". The fund shall consist of all monies\n\nreceived by the Council other than appropriated funds. The\n\nrevolving fund shall be a continuing fund not subject to fiscal year\n\nlimitations and shall be under the control and management of the\n\nCouncil. Expenditures from this fund shall be made pursuant to the\nrevolving\n\nfund for the Council, to be designated the \"District Attorneys\n\nCouncil Revolving Fund\". The fund shall consist of all monies\n\nreceived by the Council other than appropriated funds. The\n\nrevolving fund shall be a continuing fund not subject to fiscal year\n\nlimitations and shall be under the control and management of the\n\nCouncil. Expenditures from this fund shall be made pursuant to the\n\npurposes of this act and without legislative appropriation.\n\nWarrants for expenditures shall be drawn by the State Treasurer\n\nbased on claims signed by the authorized employee or employees of\n\nthe Council and approved for payment by the Director of the Office\n\nof Management and Enterprise Services.\n\nJ.
