Stat. tit. 19, § 19-215.39","heading":"Narrative report of offenses for offenders sentenced to","body":"incarceration for more than five years.\n\nA. Upon the arrest, conviction and sentencing of any defendant\n\nto the custody of the Department of Corrections, the district\n\nattorney of the county in which the crime was committed shall\n\nprepare a written narrative report describing the commission of the\n\noffense and any factors which might enhance or diminish the gravity\n\nof the offender's conduct.\n\nB. The report shall be provided to the Department of\n\nCorrections and the Pardon and Parole Board, together with the\n\njudgment and sentence in the case and any victim impact statements\n\npresented to the court in the case.\n\nC. The form to be used for this report shall be developed and\n\ndistributed by the District Attorneys Council.\n\nD. The provisions of this section shall not apply to offenders\n\nsentenced to terms of incarceration of five (5) years or less.\n\nE. No allegations or recitations of alleged facts contained in\n\nany narrative submitted pursuant to the requirements of this section\n\nshall give rise to any cause of action by the defendant against the\n\nsubmitting agency unless the defendant shall first object to such\n\nallegation or recitation in writing, with notice to the submitting\n\nagency. The submitting agency shall be given thirty (30) days\n\nfollowing such notice to withdraw or amend any such allegation or\n\nrecitation objected to.
