As used in this section, “community service program” means a\n\nstructured program for offenders sentenced to community service to\n\nwork in or on any government property and designed to save public\n\nfunds or improve the community that has been approved by a majority\n\nvote of the board of county commissioners of the county.\n\nB. In any county in this state that has a community service\n\nprogram the county commissioners may, pursuant to a majority vote of\n\nthe board of county commissioners of the county, impose a community\n\nservice program assessment as provided for pursuant to the\n\nprovisions of this section.\n\nC. In every county in which a community service program\n\nassessment has been imposed pursuant to subsection B of this\n\nsection, in addition to the imposition of any costs, penalties or\n\nfines imposed pursuant to law by the district court, any person\n\nconvicted of, pleading guilty or nolo contendere to, or agreeing to\n\na deferred judgment procedure under the provisions set forth in the\n\nOklahoma Statutes for any felony or misdemeanor shall be ordered to\n\npay a community service program assessment of at least Twenty-five\n\nDollars ($25.00), but not to exceed Two Hundred Fifty Dollars\n\n($250.00), for each felony or misdemeanor for which the person is\n\nordered to complete community service in the community service\n\nprogram of the county.\n\nD. In every county in which a community service program\n\nassessment has been imposed pursuant to subsection B of this\n\nsection, in addition to the imposition of any costs, penalties or\n\nfines imposed pursuant to law by the district court, a community\n\nservice program assessment of at least Twenty-five Dollars ($25.00),\n\nbut not to exceed Two Hundred Fifty Dollars ($250.00), shall be\n\nlevied by the court against the child at the time the child is\n\nadjudicated by the court as a delinquent child or agrees to a\n\ndeferred adjudication, provided the delinquent child is ordered to\n\ncomplete community service in the community service program of the\n\ncounty.\n\nE. In every county in which a community service program\n\nassessment has been imposed pursuant to subsection B of this\n\nsection, in addition to the imposition of any costs, penalties or\n\nfines imposed pursuant to law, in any municipal court of record in\n\nwhich the defendant is ordered by the court to pay municipal court\n\ncosts and to complete community service in the community service\n\nprogram of the county, the court shall levy and collect a community\n\nservice program assessment of at least Twenty-five Dollars ($25.00),\n\nbut not to exceed Two Hundred Fifty Dollars ($250.00). The\n\nmunicipal court clerk collecting said assessment is authorized to\n\ndeduct ten percent (10%) of the amount collected for administrative\n\ncosts.\n\nF. All monies collected pursuant to subsections C, D and E of\n\nthis section shall be forwarded monthly by the applicable court\n\nclerk to the community service program assessment revolving fund of\n\nthe appropriate county created pursuant to subsection G of this\n\nsection.\n\nG. There are hereby created community service program\n\nassessment revolving funds in each county in which the county has\n\nlevied an assessment pursuant to the provisions of subsection B of\n\nthis section. Each such revolving fund shall be designated for use\n\nwithin the county to operate and administer a community service\n\nprogram and shall consist of all monies generated by such\n\nassessment. Monies in such funds shall only be expended for the\n\npurposes specifically designated as required by this section.
