Stat. tit. 19, § 19-421.1","heading":"Trade-in of certain property - Procedure for sale of","body":"certain county property.\n\nA. The board of county commissioners is hereby authorized to\n\nuse any tools, apparatus, machinery or equipment belonging to the\n\ncounty, the original cost of which exceeded One Thousand Dollars\n\n($1,000.00), as a trade-in on a cash purchase or lease purchase of\n\nany other tools, apparatus, machinery or equipment.\n\nB. To establish an appraised value for an item to be sold at\n\npublic auction or traded in, the purchasing agent may refer to an\n\nindustry-recognized appraisal manual for used construction equipment\n\nto estimate the value of the item being sold, or obtain appraisal\n\nquotes from at least two vendors in the business of selling items\n\nlike the one being sold.\n\nC. Except when such items are disposed of pursuant to\n\nsubsection E, F or I of this section, the following procedures shall\n\nbe used for the sale, by the board of county commissioners, of any\n\ntools, apparatus, machinery or equipment, the original cost of which\n\nexceeded One Thousand Dollars ($1,000.00) or any information\n\ntechnology hardware or software having an original cost of Five\n\nHundred Dollars ($500.00) or more, belonging to the county:\n\n1. The board of county commissioners shall give notice of such\n\nsale by publication in a newspaper of general paid circulation in\n\nthe county for two successive weekly issues;\n\n2. Bids for such tools, apparatus, machinery or equipment on\n\nsale shall be in writing, sealed and delivered to the county clerk\n\nof such county;\n\n3. At the next regular meeting of the board of county\n\ncommissioners after the expiration of fifteen (15) days from the\n\ndate of first publication of notice of the sale, the board of county\n\ncommissioners shall open such bids and award such tools, apparatus,\n\nmachinery or equipment to the highest and best bidder with the\n\noption of rejecting all bids; and\n\n4. The board of county commissioners may hold a public auction\n\nor use an Internet auction, which may include online bidding, in\n\nlieu of advertising for sealed bids as provided above. Such auction\n\nshall be advertised as provided herein.\n\nD. A board of county commissioners may sell any materials,\n\ntools, apparatus, machinery or equipment to a tribal governmental\n\nentity or state agency, if the agency is subject to the Oklahoma\n\nCentral Purchasing Act. The board of county commissioners may\n\npurchase materials, tools, apparatus, machinery or equipment from a\n\nstate agency, if the agency is subject to the Oklahoma Central\n\nPurchasing Act.\n\nE. The board of county commissioners may, by resolution, enter\n\ninto an agreement with any tribal governmental entity or other\n\ncounty or political subdivision for the purpose of selling,\n\ntransferring, trading or otherwise disposing of equipment or\n\nmaterials at a price agreed upon by both governing bodies.\n\nTransactions made pursuant to this subsection shall not be subject\n\nto the requirements in subsection C of this section.\n\nF. Advertisement of surplus property consigned to sell at a\n\nCircuit Engineering District auction shall be provided by the\n\nauction company under contract to conduct the sale. Advertising\n\nshall be provided to attract the most potential buyers. Advertising\n\nmedia may include, but not be limited to, sale flyers, newspapers,\n\nradio, television, and Internet postings.\n\nG. Pursuant to the authority of Section 1 of this title, boards\n\nof county commissioners shall have authority, under such statute and\n\nin consideration of the procedures in this section to sell real\n\nproperty belonging to the county without declaring such property\n\nsurplus under the following conditions:\n\n1. A certified appraisal of the county property shall be\n\nperformed to determine the market value of the property and accepted\n\nby the board of county commissioners;\n\n2. After acceptance of the certified appraisal, the board of\n\ncounty commissioners shall, pursuant to the requirements of this\n\nsection, give notice of such sale by publication in a newspaper of\n\ngeneral paid circulation in the county for two successive weekly\n\nissues;\n\n3. Bids for the real property shall be in writing, sealed and\n\ndelivered to the county clerk of such county;\n\n4. At the next regular meeting of the board of county\n\ncommissioners after the expiration of fifteen (15) days from the\n\ndate of first publication of notice of sale, the board of county\n\ncommissioners shall open such bids;\n\n5. A successful bid must be no less than the market value of\n\nthe real property to be considered by the board of county\n\ncommissioners for acceptance. The board of county commissioners\n\nreserves the right to reject any and all bids;\n\n6. If more than one bid is above the market value of the real\n\nproperty, the board of county commissioners shall have the right to\n\ncompel the potential buyers of the real property who have bid above\n\nthe market amount to enter into public auction conducted by the\n\nchairman of the board of county commissioners after the opening of\n\nsuch bids, to establish the highest bid for the property in order to\n\nassure that the county is receiving adequate consideration for the\n\nproperty;\n\n7. A majority vote of the board of county commissioners shall\n\nbe required to determine the successful bidder of the real property.\n\nUpon awarding the bid, either through sealed bid or by conducting a\n\npublic auction of those bidders who bid more than the market value\n\nof the real property, the board of county commissioners shall have\n\nthe right to pledge the occupied property, using an irrevocable bond\n\nor letter of credit, as provided for in paragraph 10 of this\n\nsubsection, as collateral in order to finance bonds to purchase\n\nother real property or build a replacement building, or both;\n\n8. If the sale price is less than the estimated cost of new\n\nland purchase or construction, then said sales contract shall be\n\ncontingent upon the public approval of bond funding or other\n\nauthorized funding to allow the complete payment of the contemplated\n\nproject;\n\n9. The board of county commissioners shall have authority\n\npursuant to paragraphs 5 and 6 of Section 1 of this title to make\n\nany order concerning the sale of such property contingent upon a\n\nclosing date in the future in order to continue to use said real\n\nproperty until a replacement building is completed. Upon completion\n\nof the replacement building, the board of county commissioners shall\n\nexecute all documents and title transfers pertaining to said real\n\nproperty to the successful bidder;\n\n10. The successful bidder shall execute an irrevocable bond or\n\nletter of credit with a surety company or bank licensed to do\n\nbusiness in the State of Oklahoma and organized under the corporate\n\nlaws of the State of Oklahoma and registered with the Secretary of\n\nState of Oklahoma equal to the amount of the purchase price of the\n\nreal property within fifteen (15) days of awarding of the bid.\n\nFailure to provide either an irrevocable bond or letter of credit in\n\nfavor of the board of county commissioners within said time\n\nlimitation shall act as a rejection and cancellation by the board of\n\nthe award of bid and said board may, at that point, enter into a\n\ncontract with any secondary or subsequent bidder that meets the\n\naforementioned qualifications without further notice; and\n\n11. If there are no bids submitted or all submitted bids are\ntter of credit in\n\nfavor of the board of county commissioners within said time\n\nlimitation shall act as a rejection and cancellation by the board of\n\nthe award of bid and said board may, at that point, enter into a\n\ncontract with any secondary or subsequent bidder that meets the\n\naforementioned qualifications without further notice; and\n\n11. If there are no bids submitted or all submitted bids are\n\nless than the market value of the real property after the expiration\n\nof fifteen (15) days from the date of first publication of notice of\n\nsale, the board of county commissioners shall publish the notice of\n\nsale and accept bids for a second time complying with the\n\nrequirements of paragraphs 2 through 4 of this subsection. If there\n\nare no bids submitted or all submitted bids are less than the market\n\nvalue of the real property after the expiration of fifteen (15) days\n\nfrom the date of second publication of notice of sale, the board of\n\ncounty commissioners shall have the right to sell real property,\n\nupon majority vote, without any bidding procedure or auction,\n\ndirectly to any person or entity for an amount that is not less than\n\nthe highest bid previously submitted through any previous bidding\n\nprocedures provided in this subsection.\n\nH. The board of county commissioners may solicit telephone bids\n\nfor the removal of recyclable materials.\n\nI.
