Stat. tit. 19, § 19-421.2","heading":"Surplus machinery, equipment or vehicles - Transfer to","body":"political subdivisions.\n\nA. A unanimous vote of the board of county commissioners may\n\ntransfer any machinery, equipment or vehicle belonging to the\n\ncounty, which is deemed by the board to be surplus, to a political\n\nsubdivision of the state which is in need of such machinery,\n\nequipment or vehicle. Upon such transfer, the subject property\n\nshall be removed from the inventory of the county.\n\nB. The board of county commissioners shall not deem any\n\nproperty to be surplus during the period when the elections of any\n\ntwo county commissioners occur at the same time. This prohibition\n\nshall only apply to the property in use by and/or recorded on the\n\ninventory of the district of the county commissioner(s), the\n\nelections of which are set for the same date and not the remaining\n\ncounty officers. This prohibition shall cease to apply to any\n\nproperty in use by and/or recorded on the inventory of the district\n\nof any individual incumbent county commissioner who draws no\n\nopponent or who wins reelection at either the primary or general\n\nelection. The prohibition of declaring county property or material\n\nsurplus shall:\n\n1. Begin thirty (30) days before the filing period for the\n\nelections of any two or more county commissioners in a county; and\n\n2. Except as otherwise provided in this section, end the day\n\nafter two or more county commissioners are sworn in as such.\n\nC. If two or more incumbents draw no opponents or if two or\n\nmore incumbent county commissioners both win reelection, either at\n\nthe primary, special, or general election, the prohibition of\n\ndeclaring county property or material surplus until the swearing in\n\nof county officials shall be removed and the county may dispose of\n\nsurplus property as provided in subsection A of this section.\n\nD. When the political subdivision receiving such property\n\ndeclares same to be surplus, the governing body shall give written\n\nnotice to the county of its intent to transfer such property back to\n\nthe county. The board of county commissioners shall have up to\n\nfifteen (15) days from the date of receipt of such notice to either\n\naccept or reject the property.
