Stat. tit. 19, § 19-514.4v2","heading":"Court cost compliance program established – Contracts","body":"with court cost compliance liaisons – Recovery on outstanding cost-\n\nrelated warrants – Payment in lieu of court appearance.\n\nA. 1. Effective November 1, 2023, there is hereby established\n\na court cost compliance program. The purpose of the program shall\n\nbe to assist county sheriffs and the courts of this state with the\n\ncollection of fines, costs, fees, and assessments associated with\n\nany case in which a warrant has been issued and the case has been\n\nreferred to the court cost compliance program pursuant to Section\n\n983 of Title 22 of the Oklahoma Statutes.\n\n2. County sheriffs of any county in this state may contract\n\nwith a statewide association of county sheriffs to administer\n\ncontracts with third parties who shall be known as court cost\n\ncompliance liaisons. The court cost compliance liaison may assist\n\nwith attempting to locate and notify persons of their outstanding\n\nmisdemeanor or cost-related warrants and recover and maintain\n\naccounts relating to past due fines, fees, costs, and assessments.\n\nCounty sheriffs contracting with a statewide association of county\n\nsheriffs for the administration of third-party contracts may assign\n\ntheir rights and duties regarding these contracts to the\n\nassociation.\n\nB. A person may make payment directly to the court, as allowed\n\nby law, or the court cost compliance liaison, as allowed, shall be\n\nauthorized to accept payment on misdemeanor or cost-related warrants\n\non all cases referred pursuant to Section 983 of Title 22 of the\n\nOklahoma Statutes by various means including but not limited to\n\npayment by phone, mail, or Internet, and in any payment form\n\nincluding but not limited to personal, cashier’s, traveler’s,\n\ncertified, or guaranteed bank check, postal or commercial money\n\norder, nationally recognized credit or a debit card, or other\n\ngenerally accepted payment form. Any payment collected and received\n\nby the court cost compliance liaison shall be paid to the court\n\nclerk of the court that issued the warrant within fifteen (15) days\n\nafter receipt of the payment and proof of funds. Any payment\n\ncollected and received by the court, where the court has referred\n\nthe case to a court cost compliance liaison, shall be reported to\n\nthe court cost compliance liaison within four (4) days of receipt of\n\nthe payment. Any payment returned due to insufficient funds shall\n\nhave all insufficient fund charges incurred added to the outstanding\n\nbalance of the defendant. If a credit card payment taken by a court\n\ncost compliance liaison is determined to be a fraudulent use of the\n\ncredit card by the payor and the payment is reversed by the credit\n\ncard company or payor’s bank, the court clerk shall reverse the\n\ntransaction upon notification, return the payment to the court cost\n\ncompliance liaison, and the court cost compliance liaison shall\n\ncontinue the collection process until paid. The court clerk shall\n\nadd any additional fees for the reversal of the transaction plus the\n\nadministration fees to the outstanding balance of the defendant.\n\nCourt cost compliance liaisons shall inform individuals of their\n\nright to a cost hearing as provided in Section 983 of Title 22 of\n\nthe Oklahoma Statutes.\n\nC. As provided for by this section, a person may pay in lieu of\n\nappearance before the court and such payment accepted by the court\n\nshall constitute a finding of guilt as though a plea of nolo\n\ncontendere had been entered by the defendant as allowed by law and\n\nshall function as a written, dated, and signed plea form acceptable\n\nto the court. Such payment shall serve as a written waiver of a\n\njury trial.\n\nD. The court shall release or recall the outstanding\n\nmisdemeanor or cost-related warrant upon receipt of all sums due\n\npursuant to the warrant including the misdemeanor or cost-related\n\nwarrant, scheduled fine or sum due, all associated fees, costs and\n\nstatutory penalty assessments, and the administrative cost pursuant\nto the court. Such payment shall serve as a written waiver of a\n\njury trial.\n\nD. The court shall release or recall the outstanding\n\nmisdemeanor or cost-related warrant upon receipt of all sums due\n\npursuant to the warrant including the misdemeanor or cost-related\n\nwarrant, scheduled fine or sum due, all associated fees, costs and\n\nstatutory penalty assessments, and the administrative cost pursuant\n\nto Section 514.5 of this title, or with a mutually agreeable monthly\n\npayment plan and a down payment set at the discretion of the court\n\nat an amount no less than One Hundred Dollars ($100.00) or by order\n\nof the court. A single down payment shall be sufficient to recall\n\nall cost-related warrants against a defendant pending in a single\n\njurisdiction.\n\nE. The provisions of any contract entered into by a county\n\nsheriff shall be administered by a statewide association of county\n\nsheriffs in Oklahoma.\n\nF. The provisions of this section and Section 514.5 of this\n\ntitle shall be applicable to:\n\n1. Any misdemeanor or cost-related warrant issued pursuant to\n\nSection 983 of Title 22 of the Oklahoma Statutes or relating to any\n\nproceeding pursuant to the State and Municipal Traffic, Water\n\nSafety, and Wildlife Bail Bond Procedure Act;\n\n2. Any misdemeanor or cost-related warrant issued that allows a\n\ndefendant to resolve the matter by payment in lieu of a personal\n\nappearance in court; and\n\n3.
