Each county is hereby authorized to establish and maintain\n\nfor the benefit of nonviolent misdemeanor offenders a \"debt to\n\nsociety\" work release or community service program. When a county\n\nestablishes such program, the following requirements shall apply:\n\n1. In conjunction with the office of the district attorney, the\n\ncounty sheriff shall establish guidelines for the monitoring and\n\nenforcement of persons the program would be available to;\n\n2. The program guidelines shall provide the details for a work\n\nrelease program or a community service program;\n\n3. The program guidelines shall be approved by the district\n\njudge prior to implementation;\n\n4. Only defendants who enter a plea or are convicted of a\n\nnonviolent misdemeanor offense may be eligible for the program;\n\n5. An eight-hour work day shall translate into one (1) full day\n\nof imprisonment in a county jail. A four-hour work day shall\n\ntranslate into one-half (1/2) day of imprisonment in a county jail;\n\nand\n\n6. Counties may use the program in lieu of incarceration and/or\n\nhousing a defendant.\n\nB. 1. The sentence of the person may be reduced by earned\n\nearly release time in accordance with procedures developed and\n\npromulgated by the county sheriff and approved by the district\n\nattorney.\n\n2. The earned early release time shall be for good behavior and\n\ngood performance in the work release or community service program as\n\ndetermined by the county sheriff.\n\n3. The county sheriff shall not credit the person with earned\n\nearly release time in advance of the person actually earning the\n\ncredits.\n\n4. Under no circumstances shall the aggregate sum of earned\n\nearly release time exceed one-third (1/3) of the total sentence.\n\nC. 1. The earnings of a person participating in a work release\n\nprogram may be collected by the county.\n\n2. The county may deduct from the earnings of the work release\n\nor community service program participant amounts necessary for the\n\npayment of the following:\n\na. incarceration costs,\n\nb. administrative expenses relating to participation in\n\nthe work release or community service program,\n\nc. court-ordered victim restitution, and\n\nd. court costs and fees associated with the criminal case\n\nof the person.\n\nChild support obligations for dependents of the person, if any,\n\nshall be made as directed by the court.\n\nAny remaining balance shall be returned to the person.\n\nD. If the person violates any of the conditions of the work\n\nrelease or community service program, custody or employment, the\n\nperson shall be suspended from further participation in the work\n\nrelease or community service program.
