Stat. tit. 19, § 19-61","heading":"Jurisdiction and powers of Supreme Court - Summons - Scope","body":"of inquiry.\n\nOriginal and exclusive jurisdiction is hereby conferred upon the\n\nSupreme Court to hear and determine any action that may be brought\n\nfor the purpose of equitably dividing and distributing the property,\n\nassets and liabilities, derived through the process of taxation,\n\nbonds, warrants or other evidences of indebtedness, of any county\n\nformerly existing in the Territory of Oklahoma, between such county\n\nand any new county or counties created by the Constitution in whole\n\nor in part out of the territory of such county; and for the purpose\n\nof rendering and enforcing complete justice in any such action, the\n\nSupreme Court shall have the power to make and render all necessary\n\norders, judgments and decrees, and to issue and enforce all\n\nnecessary process, mesne, and final:\n\nProvided, that the Supreme Court shall have exclusive original\n\njurisdiction of all actions involving the custody of, or the right\n\nto transcribe the tax rolls or other records of any such county or\n\ncounties, and the ownership and distribution of the taxes assessed\n\nand collectable therein:\n\nProvided further, that, for the purpose of hearing and receiving\n\nevidence and reporting findings of law and fact, the Supreme Court\n\nmay appoint a special master in chancery in such case.\n\nThe Clerk of the Supreme Court shall issue summons which shall\n\nbe served on the defendants in any such action in the same manner as\n\nis provided by law for the issuance and service of summons in the\n\ndistrict courts of this state:\n\nProvided, that the Supreme Court shall inquire into and\n\ndetermine whether or not public property, derived through public or\n\nprivate donation or otherwise, shall be subject to division under\n\nthe terms of this article; and unless the court so determine, it\n\nshall not take into consideration, in dividing the property, assets\n\nand liabilities, any property so derived, and, in the event the\n\ncourt so determines, it shall have jurisdiction to, and shall take\n\nall such property into consideration in dividing the property,\n\nassets and liabilities aforesaid; provided, that the provisions of\n\nthis act shall apply to counties created, or attempted to be\n\ncreated, as provided by law, and subsequently dissolved by judicial\n\ndecree; and provided further, that such property, assets and\n\nliabilities acquired by any such county created and dissolved shall\n\nbe divided between or among such counties as were affected by the\n\ncreation and dissolution of such new county; and provided further,\n\nthat where a portion of such territory formerly embraced in any such\n\nnew county is now a portion of some county other than the county\n\nfrom which it was originally proposed to be taken to form such new\n\ncounty, then such other county now embracing such territory shall be\n\nconstrued to have been affected by the creation and dissolution of\n\nsuch new county as provided herein.","path":["OK Code","Title 19"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os19.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"5c836e3b803a062a9ade3123f75728edffa95bc313acb87e13a210777394813b","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-19-19-6","next":"us-ok/okla.-stat.-tit.-19-19-62"},"notice":"GroundRules: Original legal text.
