Stat. tit. 19, § 19-788","heading":"Contracts - Bids - Notice - Preference - Uncompleted","body":"contracts - Payment of personal property taxes.\n\n(a) All contracts for county hospital construction work,\n\nalteration, additions, or repairs exceeding Five Thousand Dollars\n\n($5,000.00) in any calendar year, shall be let to the lowest\n\nresponsible bidder or bidders after notice of publication in a\n\nnewspaper of general circulation published in the county where the\n\nwork is to be done in two consecutive weekly issues of the\n\nnewspaper. Each bid shall be accompanied by a certified or\n\ncashier's check equal to five percent (5%) of the bid or Ten\n\nThousand Dollars ($10,000.00), whichever is the smaller, which shall\n\nbe deposited with the board of control as a guaranty, and forfeited\n\nto the county treasurer to the credit of the county hospital fund in\n\nthe event the successful bidder fails to comply with the terms of\n\nthe proposal, and returned to the successful bidder on execution and\n\ndelivery of the bond herein provided for, and the checks of the\n\nunsuccessful bidders shall be returned to them in accordance with\n\nthe terms of the proposal.\n\n(b) All notices of the letting of contracts under this section\n\nshall state the time and place bids will be received and opened.\n\nSuch bids shall be sealed and opened only at the time and place\n\nmentioned in the notice and in the presence of a majority of the\n\nmembers of the board of control. The successful bidder for the\n\nconstruction of the work shall enter into a contract on a form\n\nfurnished and prescribed by the board of control and shall give good\n\nand sufficient performance bond in a sum equal to the contract\n\nprice, to the county, with sureties approved by the board of\n\ncontrol, to insure the proper and prompt completion of the work in\n\naccordance with the provisions of the contract and the plans and\n\nspecifications; bonds shall also be posted to protect against unpaid\n\nclaims of subcontractors, laborers, and suppliers. Provided, that\n\nif in the opinion of a majority of the board of control, the lowest\n\nresponsible bid or bids for the construction herein authorized to be\n\nconstructed shall be excessive, then and in that event the board of\n\ncontrol shall have the right to reject any or all bids and to\n\nreadvertise the same for additional bids. The board of control\n\nwithin its discretion and where it is in the best interests of\n\nhospital construction, may extend a contract not to exceed ten\n\npercent (10%) of the length and extent of the original project, such\n\nextension work to be paid for at a price not greater than the\n\ncontract unit basis. No work shall be initiated until the\n\ncontractor furnishes the board with certificates of insurance for\n\nworkmen's compensation, public liability and builders' risk.\n\n(c) When quality and prices are equal preference shall be given\n\nmaterials produced within the State of Oklahoma, and preference\n\nshall also be given construction contractors domiciled, having and\n\nmaintaining offices in and being citizen taxpayers of the State of\n\nOklahoma.\n\n(d) When any contract for the construction or improvement of a\n\ncounty hospital has not been carried out, or work thereunder has\n\nbeen suspended by virtue of an order or directive of any officer or\n\nagency of the federal or state government, issued under authority\n\nvested in or delegated to such officer or agency, or if the\n\ncontractor defaults, the board shall proceed against the contractor\n\nand/or his bonds, if he has caused the postponement or cancellation\n\nof the contract, and the board shall then have the right to\n\nadvertise in the manner provided for hereinabove to relet the\n\ncontract for the uncompleted portion.\nCounties and County Officers Page 277\n\nvested in or delegated to such officer or agency, or if the\n\ncontractor defaults, the board shall proceed against the contractor\n\nand/or his bonds, if he has caused the postponement or cancellation\n\nof the contract, and the board shall then have the right to\n\nadvertise in the manner provided for hereinabove to relet the\n\ncontract for the uncompleted portion.\n\n(e) Five percent (5%) of the total amount of money due under\n\ncontract with the board of control for county hospital construction\n\nwork shall be retained by the board until the contractor to whom\n\npayment is due files with the board a certified copy of a personal\n\ntax receipt, showing payment of personal property taxes due on the\n\ncontractor's equipment and supplies, from the county treasurer of\n\nthe county wherein the property is assessed, or is required to be\n\nassessed, and evidence of having proper workmen's compensation\n\ncoverage for employees as provided by Title 85 of the Oklahoma\n\nStatutes, Section 61.","path":["OK Code","Title 19"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os19.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"bc00633e9730f32af1575ba3eafa896d117943e01ae005ca20f6b2bf96c3df2e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-19-19-787","next":"us-ok/okla.-stat.-tit.-19-19-789"},"notice":"GroundRules: Original legal text.
