Any public works contract shall provide for partial payment\n\nbased upon work completed. The contract shall provide that up to\n\nten percent (10%) of all such partial payments made shall be\n\nwithheld as retainage. At any time the contractor has completed in\n\nexcess of fifty percent (50%) of the total contract amount, the\n\nretainage shall be reduced to not less than five percent (5%) of the\n\namount earned to date if the owner or owner's duly authorized\n\nrepresentative has determined that satisfactory progress is being\n\nmade, and upon approval by the surety. The amount retained shall be\n\nsufficient to ensure payment of:\n\n1. Any taxes due the State of Oklahoma;\n\n2. Personal property taxes or any municipal sales taxes due on\n\nthe contractor's equipment and supplies;\n\n3. Any workers compensation coverage; and\n\n4. Any amount due and owing to any subcontractor who furnished\n\nany material or equipment to the contractor or performed any labor\n\nas a subcontractor, or as an artisan or day laborer in the employ of\n\nthe contractor.\n\nB. For purposes of this section a public works contract means a\n\ncontract between a county of this state and a contractor for the\n\nconstruction, alteration, repair, improvement, moving, wrecking or\n\ndemolition of any highway, road, railroad, earthwork, building or\n\nother structure, project, development or improvement, whether it be\n\nin whole or in part.
