Upon a resolution approved by a majority of the members of\n\nthe board of county commissioners of the county or upon a petition\n\nsigned by registered voters of the county equal in number to ten\n\npercent (10%) of the total number of votes cast in the county for\n\nGovernor at the immediately preceding gubernatorial election, the\n\nmembers of the proposed charter commission shall be designated as\n\nfollows:\n\n1. Fifteen (15) members shall be designated by the board of\n\ncounty commissioners. Five members shall be designated by each\n\ncounty commissioner, at least two of which shall be residents of an\n\nunincorporated portion of the county, or residents of a municipality\n\nother than the largest municipality located within said county. The\n\nmembers designated by each county commissioner must reside in that\n\ncounty commissioner's district;\n\n2. Two members shall be designated by the county court clerk,\n\nat least one of which shall be a resident of an unincorporated\n\nportion of the county or a resident of a municipality other than the\n\nlargest municipality located within the county;\n\n3. Two members shall be designated by the county clerk, at\n\nleast one of which shall be a resident of an unincorporated portion\n\nof the county or a resident of a municipality other than the largest\n\nmunicipality located within the county;\n\n4. Two members shall be designated by the county treasurer, at\n\nleast one of which shall be a resident of an unincorporated portion\n\nof the county or a resident of a municipality other than the largest\n\nmunicipality located within the county;\n\n5. Two members shall be designated by the county assessor, at\n\nleast one of which shall be a resident of an unincorporated portion\n\nof the county or a resident of a municipality other than the largest\n\nmunicipality located within the county; and\n\n6. Two members shall be designated by the county sheriff, at\n\nleast one of which shall be a resident of an unincorporated portion\n\nof the county or a resident of a municipality other than the largest\n\nmunicipality located within the county.\n\nThe members shall be designated and their names filed with the\n\ncounty election board within thirty (30) days from the date the\n\nresolution was adopted by the board of county commissioners or the\n\ndate the petition was filed with the board.\n\nUpon the designation of the members of the proposed charter\n\ncommission as provided in this subsection, the county election board\n\nshall submit to the voters of the county at the next November\n\ngeneral election not less than ninety (90) days thereafter, or at a\n\nspecial election called for such purpose, the question:\n\n\"Shall a charter commission, to be composed of the following\n\nmembers: ________________________________ be authorized to frame\n\na proposed charter or amend an existing charter for the County\n\nof ____________?\n\n/ / YES\n\n/ / NO\"\n\nNothing in the County Home Rule Charter Act shall be construed to\n\nprevent any officer of any municipality located within the county\n\nfrom serving as a member of the charter commission.\n\nB. If the proposition receives approval by a majority of the\n\nvotes cast thereon, the chairman of the board of county\n\ncommissioners of the county shall, within sixty (60) days, call an\n\norganizational meeting of said charter commission. Such commission\n\nis hereby authorized to select a chairman and other officers as may\n\nbe necessary, to adopt rules of procedure, and to draft a proposed\n\nCounty Home Rule Charter or amendments to an existing charter. Such\n\ncommission shall complete its work on a proposed charter or\n\namendments to an existing charter within six (6) months from the\norganizational meeting of said charter commission. Such commission\n\nis hereby authorized to select a chairman and other officers as may\n\nbe necessary, to adopt rules of procedure, and to draft a proposed\n\nCounty Home Rule Charter or amendments to an existing charter. Such\n\ncommission shall complete its work on a proposed charter or\n\namendments to an existing charter within six (6) months from the\n\ntime said organizational meeting of such commission was convened.\n\nAny proposed charter or amendments to an existing charter shall be\n\npublished by the commission in a newspaper of general circulation in\n\nthe county on at least two occasions. At least seven (7) days shall\n\nelapse between the first and last day of publication. The first day\n\nof such publication shall be within forty-five (45) days from the\n\ndate the commission submits its proposed charter or amendments to an\n\nexisting charter. Copies of the proposed charter or amendments to\n\nthe existing charter shall be made available for distribution to the\n\nqualified voters of the county at the place where meetings of the\n\nboard of county commissioners of the county are usually held.\n\nC. Within ninety (90) days after the commission submits its\n\nproposed charter or amendments to an existing charter to the board\n\nof county commissioners of the county, the officer or agency\n\nresponsible for certifying public questions shall submit to the\n\nvoters of the county at the next regular countywide election or at a\n\nspecial election which may be called for said purpose by the board\n\nof county commissioners, the question:\n\n\"Shall the proposed charter (or amendments) for _________ County\n\nbe adopted?\n\n/ / YES\n\n/ / NO\"\n\nSaid charter or said amendments shall become effective if approved\n\nby a majority of the registered voters voting thereon, subject to\n\nprovisions of the Oklahoma Constitution and laws of this state.","path":["OK Code","Title 19"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os19.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"ec91be0f62c4f3b305b4359d97bd3f568eebb7f3a8f15cee68fae79a56d32669","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-19-19-8.2","next":"us-ok/okla.-stat.-tit.-19-19-8.4"},"notice":"GroundRules: Original legal text.
